【摘要】：隨著我國經(jīng)濟和社會的發(fā)展,工業(yè)化水平不斷提高,水污染現(xiàn)象日益嚴重,由此引發(fā)的侵權(quán)糾紛及環(huán)境破壞已成為我國的一大社會問題。作為一種特殊的侵權(quán)行為,現(xiàn)行的水污染侵權(quán)民事救濟制度與司法實踐已嚴重落后于時代,難以保障受害人的權(quán)益得到充分的救濟,水污染導致的生態(tài)損害的賠償與補償更難以實現(xiàn)。檢討我國水污染侵權(quán)民事救濟制度,存在立法籠統(tǒng)不完善和責任制度、程序性保障、社會化補償、損害評估制度不健全等方面的不足�；谖覈鴩�,借鑒發(fā)達國家的有益經(jīng)驗,我國應當完善水污染侵權(quán)民事救濟制度,主要途徑是確立公民環(huán)境權(quán)、設(shè)立專門立法、健全損害賠償制度和評估體系,構(gòu)建社會化補償機制,探索建立環(huán)境公益民事訴訟制度,建立流域司法管轄機制及環(huán)保法庭,完善訴訟當事人、訴訟時效等程序性保障制度,發(fā)展污染司法鑒定機構(gòu),建立有利于污染證據(jù)調(diào)取的環(huán)境信息公開制度,等等。專門立法是前提,其它相關(guān)制度的完善應當在該部法律中予以系統(tǒng)規(guī)定以統(tǒng)一指導司法實踐。這部法律將采取民事與行政銜接、實體與程序一體化規(guī)定的立法模式。
[Abstract]:With the development of our country's economy and society, the level of industrialization is increasing, and the phenomenon of water pollution is becoming more and more serious. The tort dispute and environmental damage caused by it have become a major social problem in our country. As a special tort, the current civil relief system and judicial practice of water pollution tort have lagged behind the times, and it is difficult to protect the rights and interests of the victims to get adequate relief. Compensation and compensation for ecological damage caused by water pollution are more difficult to achieve. To review the civil relief system of water pollution tort in our country, there are some shortcomings such as imperfect legislation and responsibility system, procedural protection, socialized compensation, imperfect damage assessment system and so on. Based on the situation of our country and the beneficial experience of developed countries, our country should perfect the civil relief system of water pollution tort, the main way is to establish citizen's environmental right, to establish special legislation, to perfect the system of compensation for damages and the evaluation system. To construct the social compensation mechanism, to explore the establishment of the environmental public welfare civil litigation system, to establish the watershed judicial jurisdiction mechanism and the environmental protection court, to perfect the procedural safeguard system such as litigant, limitation of action and so on, and to develop the pollution judicial appraisal institution. To establish an environmental information disclosure system conducive to the collection of pollution evidence, and so on. Special legislation is a prerequisite, and the perfection of other relevant systems should be systematically stipulated in the Ministry's laws to guide judicial practice. This law will adopt the legislative model of civil and administrative convergence, entity and procedure integration.
