【摘要】： 隨著環(huán)境污染和資源短缺的日益嚴重,循環(huán)經(jīng)濟作為一種新型的經(jīng)濟發(fā)展模式在國際社會上逐漸成為發(fā)展的趨勢。二十世紀九十年代循環(huán)經(jīng)濟開始傳入中國,由于中國環(huán)境和資源面臨的問題急切需要循環(huán)經(jīng)濟這樣的經(jīng)濟發(fā)展模式,所以循環(huán)經(jīng)濟在中國越來越受到重視。循環(huán)經(jīng)濟的發(fā)展需要有法律的保障作為基礎(chǔ),這是因為法律規(guī)范對循環(huán)經(jīng)濟的發(fā)展有引導和促進作用,法律有國家的強制力作為后盾,在保障循環(huán)經(jīng)濟的發(fā)展上有其他手段沒有的優(yōu)越性�；谶@樣的原因,完善循環(huán)經(jīng)濟法律體系就顯得必要而且迫切。 首先,本文是從法律的角度來闡釋循環(huán)經(jīng)濟的發(fā)展,對循環(huán)經(jīng)濟的概念進行了界定,關(guān)于循環(huán)經(jīng)濟的概念在理論界存在兩種學說四中觀點,筆者通過對比分析認為循環(huán)經(jīng)濟作為一種經(jīng)濟的發(fā)展模式是一種合理的觀點。同時,對循環(huán)經(jīng)濟法的性質(zhì)進行詳盡的闡述,認為循環(huán)經(jīng)濟法應(yīng)該作為一種獨立的法律部門。在此基礎(chǔ)上對我國循環(huán)經(jīng)濟法律體系作出了描述。 其次,本文通過對比分析的方法對中國和外國的循環(huán)經(jīng)濟法律體系作了系統(tǒng)的比較研究。循環(huán)經(jīng)濟發(fā)展比較完善的國家是日本和德國,文章重點介紹了德國和日本循環(huán)經(jīng)濟法律體系是怎樣為本國的循環(huán)經(jīng)濟的發(fā)展保駕護航的,從中找出促進循環(huán)經(jīng)濟健康發(fā)展的經(jīng)驗。對中國循環(huán)經(jīng)濟法律體系的分析是從現(xiàn)有體系的狀況進行的,在這一部分中重點介紹了新出臺的《中華人民共和國循環(huán)經(jīng)濟促進法》的內(nèi)容和特點,并指出了該法存在不不足之處。通過比較分析中國和外國在循環(huán)經(jīng)濟法律體系的不同之處,找出中國在循環(huán)經(jīng)濟法律體系的建設(shè)上的不足之處 最后,在結(jié)合我國具體國情的基礎(chǔ)之上,筆者從法律規(guī)范性文件的修訂完善和相關(guān)法律制度的完善方面對我國循環(huán)經(jīng)濟法律體系的完善提出建議。筆者提出我國應(yīng)該對《循環(huán)經(jīng)濟促進法》進行適當?shù)男薷?改變它作為促進性法律的不適應(yīng)循環(huán)經(jīng)濟發(fā)展要求的地位,將其名稱改為《循環(huán)經(jīng)濟法》。并將它作為循環(huán)經(jīng)濟法律體系的基本法,在這部法律的基礎(chǔ)之上修訂和完善其他的法律規(guī)范,并制定基本法實施的配套標準和實施細則。
[Abstract]:With the increasingly serious environmental pollution and the shortage of resources, circular economy as a new economic development model has gradually become a trend of development in the international community. Circular economy began to be introduced into China in 1990s. Due to the problems of environment and resources in China, circular economy has been paid more and more attention in China because of the urgent need for such economic development model as circular economy. The development of circular economy needs the legal guarantee as the foundation, this is because the legal norm has the guidance and the promotion function to the circular economy development, the law has the national coercive force as the backing, In the protection of the development of circular economy, there are no other means of superiority. For this reason, it is necessary and urgent to perfect the legal system of circular economy. First of all, this paper explains the development of circular economy from the angle of law, defines the concept of circular economy, and there are two theories and four viewpoints on the concept of circular economy in the theoretical circle. Through comparative analysis, the author thinks that circular economy as an economic development model is a reasonable point of view. At the same time, the nature of circular economy law is elaborated in detail, and the circular economy law should be regarded as an independent legal department. On this basis, the legal system of circular economy in China is described. Secondly, this paper makes a systematic comparative study on the legal system of circular economy between China and foreign countries by means of comparative analysis. The countries with relatively perfect circular economy development are Japan and Germany. The article focuses on how Germany and Japan's circular economy legal system can protect the development of their own circular economy. Find out the experience of promoting the healthy development of circular economy. The analysis of China's circular economy legal system is carried out from the current situation. In this part, the contents and characteristics of the newly issued Circular economy Promotion Law of the people's Republic of China are emphatically introduced. It is pointed out that there is no shortage in the method. By comparing and analyzing the differences between China and foreign countries in the legal system of circular economy, this paper finds out the deficiency in the construction of the legal system of circular economy in China. Finally, on the basis of the specific national conditions of our country, the author puts forward some suggestions on the perfection of the legal system of circular economy in China from the aspects of the revision of the legal normative documents and the perfection of the relevant legal system. The author puts forward that the circular economy promotion law should be amended properly in our country to change its status as a promoting law which does not meet the requirements of the development of circular economy and change its name to "circular economy law". It is regarded as the basic law of the legal system of circular economy, and other legal norms are revised and perfected on the basis of this law, and the supporting standards and detailed rules for the implementation of the basic law are formulated.
