跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制相關(guān)法律問(wèn)題研究

【摘要】:隨著跨區(qū)域間在環(huán)境污染防治、自然資源開(kāi)發(fā)利用等方面的糾紛不斷增多,突顯出我國(guó)在環(huán)境保護(hù)方面的跨區(qū)域行政協(xié)調(diào)機(jī)制有所缺失。環(huán)境資源不僅僅是一種經(jīng)濟(jì)資源,而且具有生態(tài)系統(tǒng)的完整性、跨行政區(qū)域性和使用多元性特征,其自然生態(tài)功能區(qū)域往往與人為行政區(qū)域劃分和行政權(quán)力設(shè)置無(wú)法重合。鑒于環(huán)境保護(hù)的廣泛性,如何將區(qū)域間現(xiàn)有的有效的環(huán)境行政協(xié)調(diào)機(jī)制上升為法律要求,并且進(jìn)一步在法律層面構(gòu)建較為完善的環(huán)境行政協(xié)調(diào)機(jī)制,從而對(duì)環(huán)境進(jìn)行有效、和諧的跨區(qū)域保護(hù),已經(jīng)成為環(huán)境法學(xué)界的一個(gè)重要課題。 本文從跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的可行性研究入手,分析了我國(guó)現(xiàn)行環(huán)境行政管理體制的局限性,認(rèn)為環(huán)境管理中行政區(qū)域劃分與環(huán)境保護(hù)整體目標(biāo)實(shí)現(xiàn)發(fā)生脫節(jié)。目前,以行政區(qū)域?yàn)榛A(chǔ)的環(huán)境行政管理體制整體性與協(xié)調(diào)性不足,容易使地方局部利益的擴(kuò)張性放大,因此跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的引入就顯得刻不容緩。在對(duì)跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的內(nèi)涵進(jìn)行定義之后,闡述了其與現(xiàn)行環(huán)境行政管理體制的功能互補(bǔ),并著重揭示了區(qū)域經(jīng)濟(jì)一體化是跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制構(gòu)建的現(xiàn)實(shí)基礎(chǔ),而生態(tài)系統(tǒng)管理理念則是該機(jī)制的理性支撐。 流域管理體系在我國(guó)已經(jīng)建立并發(fā)展了相當(dāng)長(zhǎng)的時(shí)間,其現(xiàn)狀與功能特點(diǎn)對(duì)跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制具有一定的借鑒作用。本人認(rèn)為跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制應(yīng)該打破行政區(qū)域劃分對(duì)生態(tài)系統(tǒng)完整性的人為分割,同時(shí)強(qiáng)調(diào)環(huán)境行政決策與執(zhí)行的系統(tǒng)性與協(xié)調(diào)性。另外,國(guó)內(nèi)外現(xiàn)有跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的探索,也為跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的完善路徑開(kāi)拓了視野。 本文在第四部分對(duì)跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的完善路徑進(jìn)行了分析。首先提出我國(guó)跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制應(yīng)該遵循的原則及其協(xié)調(diào)內(nèi)容,著重闡述了我國(guó)跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制完善的要點(diǎn)。在此基礎(chǔ)上,提出機(jī)制完善的具體方式,包括完善跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)構(gòu)的功能定位,明確行政協(xié)議制度的法律效力等,最后本文認(rèn)為應(yīng)該整合現(xiàn)有區(qū)域環(huán)境規(guī)章,進(jìn)行區(qū)域環(huán)境立法,以期提供跨區(qū)域環(huán)境行政協(xié)調(diào)機(jī)制的法律依據(jù)。
[Abstract]:With the increase of disputes in environmental pollution prevention and control, exploitation and utilization of natural resources among different regions, the lack of cross-regional administrative coordination mechanism in environmental protection in China has been highlighted. Environmental resources are not only a kind of economic resources, but also have the characteristics of ecosystem integrity, cross-administrative regionality and multi-use. The natural ecological functional areas of environmental resources are often unable to coincide with the division of artificial administrative regions and the establishment of administrative power. In view of the extensive nature of environmental protection, how to raise the existing effective environmental administrative coordination mechanism between regions to legal requirements, and to further construct a more perfect environmental administrative coordination mechanism at the legal level, so as to make the environment effective, Harmonious cross-regional protection has become an important topic in the field of environmental law. This paper begins with the feasibility study of the coordination mechanism of cross-regional environmental administration, analyzes the limitations of the current environmental administrative management system in China, and points out that the division of administrative regions in environmental management is out of touch with the realization of the overall goal of environmental protection. At present, the environmental administrative management system based on administrative region is lack of integrity and coordination, and it is easy to enlarge the local interests. Therefore, the introduction of cross-regional environmental administrative coordination mechanism is urgent. After defining the connotation of the trans-regional environmental administrative coordination mechanism, this paper expounds its complementary functions with the current environmental administrative management system, and emphatically reveals that regional economic integration is the realistic basis for the construction of the cross-regional environmental administrative coordination mechanism. The concept of ecosystem management is the rational support of this mechanism. Watershed management system has been established and developed for a long time in our country, its present situation and function characteristic have certain reference function to the cross-regional environmental administrative coordination mechanism. In my opinion, the inter-regional environmental administrative coordination mechanism should break the artificial division of the integrity of the ecosystem in the division of administrative regions, and emphasize the systematization and coordination of environmental administrative decision-making and implementation. In addition, the exploration of the existing cross-regional environmental administrative coordination mechanism at home and abroad also broadens the vision for the perfect path of cross-regional environmental administrative coordination mechanism. In the fourth part, the paper analyzes the perfect path of cross-regional environmental administrative coordination mechanism. Firstly, the paper puts forward the principles and contents of the coordination mechanism of cross-regional environmental administration in our country, and emphatically expounds the key points of perfecting the mechanism of cross-regional environmental administrative coordination in China. On this basis, the paper puts forward the specific ways to perfect the mechanism, including improving the functional orientation of the administrative coordination agency of cross-regional environment, clarifying the legal effect of the administrative agreement system, etc. Finally, this paper thinks that the existing regional environmental regulations should be integrated. Carry on the regional environmental legislation in order to provide the legal basis of the cross-regional environmental administrative coordination mechanism.
