【摘要】： 海洋面積遼闊,約占地球表面積的71%,是巨大的資源寶庫,是地球生命的發(fā)源地。海洋環(huán)境是環(huán)境資源重要的組成部分,然而,隨著人類社會(huì)開發(fā)海洋與利用海洋活動(dòng)的不斷增多,海洋環(huán)境污染現(xiàn)象也日趨嚴(yán)重。全球海洋環(huán)境的迅速惡化,使人類生存的基本條件受到很大威脅;國際海洋環(huán)境犯罪行為的日趨嚴(yán)重,也使人類環(huán)境權(quán)遭到前所未有的侵害。 本文首先從海洋環(huán)境污染的現(xiàn)狀分析入手,預(yù)測海洋環(huán)境污染的發(fā)展趨勢。海洋與其他自然資源相比,具有更強(qiáng)的國際性,一個(gè)國家境內(nèi)的海洋環(huán)境污染行為不僅會(huì)破壞本國環(huán)境系統(tǒng),而且很可能殃及其他國家乃至危及整個(gè)地球的生態(tài)系統(tǒng)。鑒于海洋環(huán)境污染行為存在的巨大危害性,本文前三部分通過對(duì)國內(nèi)外防治海洋環(huán)境污染的相關(guān)立法的對(duì)比研究,論證將海洋環(huán)境污染認(rèn)定為犯罪并將其上升到國際犯罪加以懲治的必要性與合理性,第四部分結(jié)合我國目前海洋環(huán)境犯罪的現(xiàn)狀,闡述了我國在預(yù)防、打擊海洋環(huán)境犯罪方面做出的努力以及存在的問題,有針對(duì)性的提出相關(guān)修改建議,文章的最后部分對(duì)懲治危害海洋環(huán)境國際犯罪的司法合作進(jìn)行了研究,以期在司法實(shí)踐中對(duì)于打擊海洋環(huán)境犯罪有所裨益。
[Abstract]:The ocean is a vast area, accounting for about 71% of the earth's surface area, is a huge treasure trove of resources, is the birthplace of life on the earth. The marine environment is an important part of the environmental resources. However, with the increasing activities of exploiting and utilizing the ocean in human society, the pollution of the marine environment is becoming more and more serious. With the rapid deterioration of the global marine environment, the basic conditions for human survival are greatly threatened, and the crimes committed by the international marine environment are becoming more and more serious, which also make the human environmental rights suffer unprecedented infringement. In this paper, the current situation of marine environmental pollution is analyzed, and the development trend of marine environmental pollution is forecasted. Compared with other natural resources, the ocean has a stronger international character. The pollution behavior of marine environment in one country will not only destroy its own environmental system, but also possibly endanger the ecosystem of other countries and even the whole earth. In view of the great harmfulness of marine environmental pollution behavior, the first three parts of this paper compare and study the relevant legislation of preventing and controlling marine environmental pollution at home and abroad. This paper demonstrates the necessity and rationality of recognizing marine environmental pollution as a crime and raising it to an international crime to punish it. The fourth part expounds the current situation of marine environmental crime in China. The efforts and problems in the fight against crimes against the marine environment, and the relevant suggestions for modification are put forward. In the last part of the article, the judicial cooperation in punishing international crimes against the marine environment is studied. In order to fight against marine environmental crimes in judicial practice.
