【摘要】: 循環(huán)經(jīng)濟(jì)是符合可持續(xù)發(fā)展理念的一種經(jīng)濟(jì)增長(zhǎng)模式,環(huán)境標(biāo)準(zhǔn)是環(huán)境法體系的重要組成部分,是環(huán)境立法、執(zhí)法、司法、守法諸環(huán)節(jié)有效運(yùn)行的基礎(chǔ)。 然而,我國的環(huán)境標(biāo)準(zhǔn)由于缺乏循環(huán)經(jīng)濟(jì)理念的指導(dǎo),因此出現(xiàn)了很多問題諸如環(huán)境標(biāo)準(zhǔn)與國際接軌不夠,公眾參與程度不高,沒有切實(shí)可行的標(biāo)準(zhǔn)評(píng)價(jià)機(jī)制等問題,阻礙了環(huán)境標(biāo)準(zhǔn)作用的發(fā)揮。實(shí)際上循環(huán)經(jīng)濟(jì)和環(huán)境標(biāo)準(zhǔn)之間是互相促進(jìn)的,在我國環(huán)境法制建設(shè)中,要使環(huán)境標(biāo)準(zhǔn)制度真正成為防治環(huán)境污染,保護(hù)環(huán)境的重要工具,必須跳出末端治理的槽臼,把清潔生產(chǎn)、循環(huán)經(jīng)濟(jì)的理念融入到環(huán)境標(biāo)準(zhǔn)的創(chuàng)制中去。 美國、歐盟等發(fā)達(dá)國家在環(huán)境標(biāo)準(zhǔn)的管理和制定方面很多都體現(xiàn)了循環(huán)經(jīng)濟(jì)的理念,他們的成功經(jīng)驗(yàn)給我們提供了重要啟示,那就是只有在循環(huán)經(jīng)濟(jì)理念下進(jìn)行環(huán)境標(biāo)準(zhǔn)的相關(guān)工作,環(huán)境標(biāo)準(zhǔn)才能取得實(shí)質(zhì)效果。 我國環(huán)境標(biāo)準(zhǔn)制定過程中存在的問題有:環(huán)境標(biāo)準(zhǔn)的制定仍囿于末端治理階段,存在著循環(huán)經(jīng)濟(jì)理念的缺位;環(huán)境標(biāo)準(zhǔn)與國際接軌不夠;環(huán)境標(biāo)準(zhǔn)的公眾參與程度不高;環(huán)境標(biāo)準(zhǔn)制定工作資金投入不足;我國還沒有切實(shí)可行的標(biāo)準(zhǔn)評(píng)價(jià)機(jī)制等。 在循環(huán)經(jīng)濟(jì)理念下完善我國環(huán)境標(biāo)準(zhǔn)可參考以下建議:制定與清潔生產(chǎn)、循環(huán)經(jīng)濟(jì)配套的環(huán)境標(biāo)準(zhǔn);確立社會(huì)監(jiān)督、專門監(jiān)督制度和公眾參與制度;確立社會(huì)監(jiān)督、專門監(jiān)督制度和公眾參與制度;建立嚴(yán)格的環(huán)境標(biāo)準(zhǔn)法律責(zé)任制度;加大環(huán)境標(biāo)準(zhǔn)建設(shè)的資金投入,組建高素質(zhì)的環(huán)境標(biāo)準(zhǔn)隊(duì)伍;建造完善的可持續(xù)的環(huán)境標(biāo)準(zhǔn)法律體系。
[Abstract]:Circular economy is a kind of economic growth model which accords with the concept of sustainable development. Environmental standard is an important part of the environmental law system, and it is the basis of the effective operation of environmental legislation, law enforcement, judicature and law-abiding. However, due to the lack of guidance from the concept of circular economy, there are many problems in our environmental standards, such as insufficient integration of environmental standards with the international community, low level of public participation, lack of a practical standard evaluation mechanism, and so on. It hinders the role of environmental standards. In fact, circular economy and environmental standards promote each other. In the construction of environmental legal system in our country, in order to make the environmental standard system truly become an important tool to prevent and control environmental pollution and protect the environment, we must jump out of the groove of end management. The concept of cleaner production and circular economy is integrated into the creation of environmental standards. Many developed countries, such as the United States and the European Union, have embodied the concept of circular economy in the management and formulation of environmental standards, and their successful experience has provided us with important inspiration. That is, only under the concept of circular economy, environmental standards can achieve substantial results. The problems in the process of setting environmental standards in China include: the establishment of environmental standards is still confined to the stage of terminal governance, there is a lack of circular economy concept, the environmental standards are not in line with the international standards, the degree of public participation in environmental standards is not high; The investment of environmental standard-making work is not enough, and there is no feasible standard evaluation mechanism in our country. Under the concept of circular economy, we can refer to the following suggestions to perfect our environmental standards: to formulate environmental standards for clean production and circular economy; to establish social supervision, special supervision system and public participation system; to establish social supervision; Special supervision system and public participation system; establish strict environmental standards legal liability system; increase investment in environmental standards construction, set up high-quality environmental standards team; build a sound and sustainable environmental standards legal system.
