【摘要】：裁判文書是司法現(xiàn)狀的重要載體,通過對調(diào)查收集的近千份環(huán)境案件裁判文書的分析和中國的環(huán)境司法現(xiàn)狀的梳理,發(fā)現(xiàn)并就裁判文書中所涉及到的相關(guān)要素和變量,主要包括案件數(shù)量、裁判種類、文書性質(zhì)、訴訟參加人、事實(shí)認(rèn)定、裁判理由、裁判結(jié)果、案件終結(jié)等情況進(jìn)行了分析,從裁判文書角度探尋中國環(huán)境司法救濟(jì)中存在的問題及產(chǎn)生的原因,并就此提出相應(yīng)的對策。
[Abstract]:The adjudicative document is the important carrier of the judicatory present situation. Through the analysis of nearly 1,000 environmental cases adjudicative documents collected by the investigation and the combing of the current situation of environmental justice in China, the relevant factors and variables involved in the adjudicative documents are found and discussed. It mainly includes the number of cases, the types of adjudication, the nature of the documents, the participants in the proceedings, the fact determination, the reasons for the adjudication, the result of the adjudication, the termination of the case and so on. This paper probes into the existing problems and causes of environmental judicial relief in China from the angle of adjudicative documents, and puts forward corresponding countermeasures.
