【摘要】：作為執(zhí)行國家決策的基層行政機關(guān)鄉(xiāng)鎮(zhèn)政府,在近年來農(nóng)村地區(qū)環(huán)境保護方面所取得的成績是值得肯定的,其在我國生態(tài)文明建設(shè)進程中的重要地位也是不言而喻的。尤其是在黨的十八大上,決策層提出了建設(shè)“美麗中國”口號的背景下,鄉(xiāng)鎮(zhèn)政府今后的環(huán)境保護工作將面臨更大挑戰(zhàn)。但在現(xiàn)階段下,我國鄉(xiāng)鎮(zhèn)政府環(huán)境保護工作不管在理論方面還是實踐方面仍存在著一些問題與爭論,這種現(xiàn)狀對鄉(xiāng)鎮(zhèn)政府充分行使其環(huán)境保護職責(zé)產(chǎn)生了障礙。這其中主要表現(xiàn)在鄉(xiāng)鎮(zhèn)政府進行環(huán)境保護工作中的定位不清以及職責(zé)不明,同時一些學(xué)者還呼吁應(yīng)當(dāng)賦予鄉(xiāng)鎮(zhèn)政府環(huán)境保護職權(quán)以更好地保障鄉(xiāng)鎮(zhèn)政府管理本地的環(huán)保工作。本文立足于闡明我國現(xiàn)階段鄉(xiāng)鎮(zhèn)政府定位及法律法規(guī)對其何許期待的基礎(chǔ)之上,從法律條文,學(xué)術(shù)界探討焦點,實際運行機制等角度,一方面辨析目前我國現(xiàn)有的法律法規(guī)是否明確了鄉(xiāng)鎮(zhèn)環(huán)境在保護工作中的定位以及職責(zé)。同時理論分析我國現(xiàn)階段下鄉(xiāng)鎮(zhèn)政府環(huán)境保護工作的實質(zhì),找出學(xué)界關(guān)于應(yīng)當(dāng)賦予鄉(xiāng)鎮(zhèn)政府環(huán)境保護職權(quán)觀點扔有待商榷之原因,并且提出現(xiàn)階段下我國鄉(xiāng)鎮(zhèn)政府在進行環(huán)境保護工作的過程中應(yīng)以履行職責(zé)為宜的觀點；另一方面從實踐的角度,通過對筆者家鄉(xiāng)周口市周邊鄉(xiāng)鎮(zhèn)實地的走訪調(diào)查,把走訪中所獲得的鄉(xiāng)鎮(zhèn)政府環(huán)境保護工作情況以及鄉(xiāng)鎮(zhèn)地區(qū)的環(huán)境狀況與理論分析結(jié)合起來,找出目前我國部分鄉(xiāng)鎮(zhèn)政府在具體環(huán)境保護工作實踐中的問題及癥結(jié),并從一些積極的實例中提供一些解決問題的參考。最后,通過本文的研究,意圖在理論和實踐相結(jié)合的基礎(chǔ)之上,明晰我國現(xiàn)階段鄉(xiāng)鎮(zhèn)政府環(huán)境保護職責(zé)的現(xiàn)狀,針對其存在的問題提出改進意見的同時,為其今后的發(fā)展出路提出管見。
[Abstract]:As the basic administrative organ of carrying out the national policy, the township government has made great achievements in environmental protection in rural areas in recent years, and its important position in the process of ecological civilization construction in our country is also self-evident. Especially under the background of the slogan of "building a beautiful China" put forward by the policy makers at the 18th National Congress of the Party, the environmental protection work of township governments will face greater challenges in the future. However, at the present stage, there are still some problems and controversies in the environmental protection work of the township government in China, both in theory and in practice. This situation has created obstacles for the township government to fully exercise its environmental protection duties. This is mainly reflected in the unclear position and unclear responsibilities of the township government in environmental protection work. At the same time, some scholars also call for the township government to be given the power to protect the environment so as to better ensure the township government to manage the local environmental protection work. On the basis of expounding the position of township government and how the laws and regulations expect it, this paper discusses the focus of the law, the academic circles, the actual operation mechanism, and so on. On the one hand, it analyzes whether the current laws and regulations of our country clearly define the position and responsibility of the village and township environment in the protection work. At the same time, it theoretically analyzes the essence of the environmental protection work of the township government under the present stage of our country, and finds out the reasons why the academic circles should give the township government the power to protect the environment by throwing it into question. On the other hand, from the point of view of practice, through the field investigation of the villages and towns around Zhoukou, I put forward that the township government should fulfill its duties in the process of carrying out environmental protection work at the present stage. Combining the environmental protection work of the township government and the environmental situation in the township area obtained during the visit with the theoretical analysis, we find out the problems and sticking points of some township governments in the practice of specific environmental protection work in our country at present. And from some positive examples to provide some reference to solve the problem. Finally, through the research of this paper, the author intends to make clear the present situation of environmental protection responsibility of township government in China on the basis of combining theory and practice, and at the same time, put forward some suggestions for improvement in view of the existing problems. For its future development way out put forward the management opinion.
