【摘要】： 在各國的環(huán)境保護(hù)實(shí)踐中,預(yù)防觀念越來越重要。以預(yù)防功能為核心的環(huán)境行政規(guī)劃制度也日益受到重視并發(fā)揮著越來越重要的作用。目前在我國,對于環(huán)境行政規(guī)劃來說,學(xué)術(shù)界對環(huán)境行政規(guī)劃的認(rèn)識并不統(tǒng)一,導(dǎo)致有關(guān)環(huán)境行政規(guī)劃的完整理論體系尚未形成;有關(guān)環(huán)境行政規(guī)劃立法上的滯后,也在一定程度上影響了環(huán)境行政規(guī)劃應(yīng)有的權(quán)威性、嚴(yán)肅性和實(shí)施效果;理論和立法的滯后,直接影響了環(huán)境行政規(guī)劃實(shí)踐的效果。因此,對環(huán)境行政規(guī)劃展開詳細(xì)的研究是非常有必要的,不僅有助于對環(huán)境行政規(guī)劃加強(qiáng)認(rèn)識、深化理解,也為今后有關(guān)環(huán)境行政規(guī)劃的立法和實(shí)施奠定理論基礎(chǔ)。 本文首先從環(huán)境行政規(guī)劃的涵義、性質(zhì)及其在我國的地位上對環(huán)境行政規(guī)劃進(jìn)行初步的分析,具體研究了什么是環(huán)境行政規(guī)劃,環(huán)境行政規(guī)劃的具體性質(zhì)是什么,環(huán)境行政規(guī)劃在我國的地位如何。其次,介紹了環(huán)境行政規(guī)劃在我國的具體發(fā)展歷程,包括最初的孕育階段、不斷的探索階段和逐步的發(fā)展階段。再次,本文對環(huán)境行政規(guī)劃所應(yīng)遵循的原則進(jìn)行了研究,在其基本原則的基礎(chǔ)上,重點(diǎn)研究環(huán)境行政規(guī)劃所應(yīng)遵循的符合其自身特色的原則。再次,本文分別從環(huán)境行政規(guī)劃的學(xué)術(shù)研究、法律依據(jù)以及編制與實(shí)施方面對我國環(huán)境行政規(guī)劃的現(xiàn)狀及其存在的問題進(jìn)行了分析。最后,本文對我國環(huán)境行政規(guī)劃提出了一些可行性的建議,包括完善環(huán)境行政規(guī)劃體系、建立健全環(huán)境行政規(guī)劃的法定程序以及健全環(huán)境行政規(guī)劃的救濟(jì)體系三個(gè)方面的內(nèi)容。
[Abstract]:In the practice of environmental protection in various countries, the concept of prevention is becoming more and more important. The environmental administrative planning system with prevention function as the core is paid more and more attention and plays an increasingly important role. At present, for environmental administrative planning in China, the understanding of environmental administrative planning in academic circles is not uniform, resulting in the formation of a complete theoretical system of environmental administrative planning, the lagging of legislation on environmental administrative planning, To some extent, it also affects the authority, seriousness and implementation effect of environmental administrative planning, and the lag of theory and legislation directly affects the effect of environmental administrative planning practice. Therefore, it is necessary to carry out detailed research on environmental administrative planning, which is not only helpful to strengthen the understanding and deepen the understanding of environmental administrative planning, but also lays a theoretical foundation for the legislation and implementation of environmental administrative planning in the future. In this paper, the meaning and nature of environmental administrative planning and its status in our country are analyzed at first, and what is environmental administrative planning and what is the specific nature of environmental administrative planning are studied in detail. What is the status of environmental administrative planning in our country? Secondly, it introduces the specific development course of environmental administrative planning in China, including the initial gestation stage, the continuous exploration stage and the gradual development stage. Thirdly, this paper studies the principles that should be followed in the environmental administrative planning. On the basis of its basic principles, it focuses on the principles that should be followed by the environmental administrative planning in accordance with its own characteristics. Thirdly, this paper analyzes the current situation and existing problems of environmental administrative planning in China from the aspects of academic research, legal basis, compilation and implementation of environmental administrative planning. Finally, this paper puts forward some feasible suggestions on environmental administrative planning of our country, including perfecting the system of environmental administrative planning, establishing and perfecting the legal procedure of environmental administrative planning and perfecting the relief system of environmental administrative planning.
