【摘要】:黨的十六屆五中全會(huì)通過的《國(guó)民經(jīng)濟(jì)和社會(huì)發(fā)展第十一個(gè)五年規(guī)劃的建議》,提出了建設(shè)社會(huì)主義新農(nóng)村的重大歷史任務(wù)。在新農(nóng)村建設(shè)的過程中,環(huán)境侵權(quán)問題已成為了新農(nóng)村建設(shè)過程中的一個(gè)巨大阻力,新農(nóng)村環(huán)境侵權(quán)問題的解決,根源還在于從制度上構(gòu)建和完善新農(nóng)村居民的環(huán)境權(quán)利,針對(duì)目前農(nóng)村居民環(huán)境權(quán)益被侵害的現(xiàn)象,如何解決當(dāng)前農(nóng)村的環(huán)境侵權(quán)糾紛保護(hù)好農(nóng)村居民的環(huán)境權(quán)益更是我們需要研究的,而解決當(dāng)前農(nóng)村環(huán)境侵權(quán)糾紛的根本途徑在于構(gòu)建與完善我國(guó)新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制,因此,本文將如何構(gòu)建和完善新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制提出自己的一些新思路。 本文用四部分的內(nèi)容闡釋了新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制的建設(shè)問題: 第一部分,主要通過新農(nóng)村建設(shè)的內(nèi)涵、新農(nóng)村中的環(huán)境保護(hù)、新農(nóng)村建設(shè)過程中的侵權(quán)問題,引出了我國(guó)新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制。 第二部分,概述了我國(guó)新農(nóng)村環(huán)境侵權(quán)的現(xiàn)狀及居民的維權(quán)困境,我國(guó)新農(nóng)村環(huán)境侵權(quán)的現(xiàn)狀主要有:新農(nóng)村地區(qū)農(nóng)地資源污染嚴(yán)重、新農(nóng)村地區(qū)的土地資源受到嚴(yán)重蠶食、新農(nóng)村地區(qū)的水資源受到掠奪式的使用、新農(nóng)村地區(qū)的水污染嚴(yán)重、新農(nóng)村地區(qū)水資源嚴(yán)重短缺、新農(nóng)村地區(qū)的大氣污染嚴(yán)重等,而我國(guó)新農(nóng)村居民的維權(quán)困境主要有:新農(nóng)村居民在訴訟階段的被動(dòng)地位、新農(nóng)村居民污染損害賠償現(xiàn)實(shí)中的一些困難等。 第三部分,主要介紹了我國(guó)新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制的方式以及這些解決機(jī)制的弊端,現(xiàn)階段的糾紛解決方式主要有:訴訟解決方式和非訴訟解決方式兩類,而這些解決機(jī)制的弊端主要有:訴訟糾紛解決機(jī)制中的訴前鑒定程序不規(guī)范、受案范圍相對(duì)狹小、原告資格范圍相對(duì)較窄、執(zhí)行程序較弱、訴訟費(fèi)用過高等;非訴訟糾紛解決機(jī)制中的行政調(diào)解地位和效力不明確、協(xié)商和談判機(jī)制沒有完全展開等。 第四部分,作為本文重點(diǎn)論述的部分,主要從新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制的立法模式、新農(nóng)村環(huán)境侵權(quán)糾紛解決的相關(guān)立法完善、新農(nóng)村環(huán)境侵權(quán)糾紛解決其它相配套制度的完善等方面,提出了完善我國(guó)新農(nóng)村環(huán)境侵權(quán)糾紛解決機(jī)制的一些新構(gòu)想。
[Abstract]:The Eleventh Five-Year Plan for National Economic and Social Development, adopted by the Fifth Plenary session of the 16th CPC Central Committee, puts forward the great historical task of building a new socialist countryside. In the process of new rural construction, the problem of environmental tort has become a great resistance in the process of new rural construction. The solution of environmental tort in new countryside lies in the establishment and improvement of the environmental rights of new rural residents from the system. In view of the phenomenon that the environmental rights and interests of rural residents have been infringed, we need to study how to solve the current environmental infringement disputes in rural areas and protect the environmental rights and interests of rural residents. The fundamental way to solve the current environmental tort disputes in rural areas lies in the construction and improvement of the new rural environmental tort dispute resolution mechanism in China. This paper puts forward some new ideas on how to construct and perfect the new rural environmental tort dispute resolution mechanism. In this paper, four parts of the content of the new rural environmental tort dispute settlement mechanism construction: The first part, mainly through the new rural construction connotation, the new countryside environment protection, the new countryside construction process infringement question, has led our country new countryside environment infringement dispute settlement mechanism. The second part summarizes the current situation of environmental tort in new rural areas and the plight of residents' rights protection. The present situation of environmental tort in new rural areas is mainly as follows: the agricultural land resources in the new rural areas are polluted seriously, and the land resources in the new rural areas are seriously eroded. The water resources in the new rural areas are used predatory, the water pollution in the new rural areas is serious, the water resources in the new rural areas are seriously short, the air pollution in the new rural areas is serious, and so on. The dilemma of the new rural residents in China mainly includes the passive position of the new rural residents in the litigation stage and some difficulties in the reality of compensation for the pollution damage caused by the new rural residents. The third part, mainly introduces the new rural environmental tort dispute settlement mechanism and the shortcomings of these mechanisms, the current dispute resolution methods are mainly: litigation settlement and non-litigation settlement. The disadvantages of these mechanisms are: the procedure of pre-litigation appraisal is not standard, the scope of cases is relatively narrow, the scope of plaintiff qualification is relatively narrow, the execution procedure is weak, and the litigation costs are too high; The status and effectiveness of administrative mediation in non-litigation dispute settlement mechanism are not clear, and the negotiation and negotiation mechanisms are not fully developed. The fourth part, as the focus of this article, mainly from the new rural environmental tort dispute settlement mechanism of the legislative model, new rural environmental tort dispute resolution related legislation perfect, In this paper, the author puts forward some new ideas on how to perfect the mechanism of environmental tort dispute resolution in new rural areas.
