【摘要】：我國(guó)現(xiàn)行地面沉降防治法律制度的立法規(guī)定比較零散、缺乏系統(tǒng)性,同時(shí),在制度設(shè)計(jì)原則、預(yù)防性制度、區(qū)域性防治制度等方面都存在明顯的不足,應(yīng)在預(yù)防為主、統(tǒng)籌兼顧、因地制宜、分類管理、重點(diǎn)管理等原則指導(dǎo)下,不斷健全地面沉降防治法律體系。完善我國(guó)地面沉降防治法律制度的具體對(duì)策包括:健全地面沉降法律體系和管理體制,建構(gòu)地面沉降預(yù)防性法律制度,建構(gòu)區(qū)域性地面沉降防治制度,建立地面沉降行政公益訴訟救濟(jì)制度,完善相關(guān)的地下水管理、土地管理制度等。
[Abstract]:The legislative provisions of the current legal system for the prevention of land subsidence in our country are relatively scattered and lack of systematic.At the same time, there are obvious deficiencies in the principles of system design, the preventive system, the regional prevention system, and so on, which should be given priority to in prevention. Under the guidance of the principles of overall planning, local conditions, classified management and key management, the legal system of land subsidence prevention and control has been continuously improved. The specific countermeasures to perfect the legal system of land subsidence prevention in China include: perfecting the legal system and management system of land subsidence, constructing the legal system of land subsidence prevention and control, and constructing the system of regional land subsidence prevention and control. Establish the relief system of administrative public interest litigation of land subsidence, perfect the related groundwater management, land management system and so on.
