【摘要】:近年來,氣候變化已成為國際社會(huì)普遍關(guān)注的重大全球性問題。應(yīng)對(duì)氣候變化、控制碳排放已成為國際談判與合作的重要內(nèi)容,研究制定及推行國際低碳規(guī)則成為大勢所趨。為應(yīng)對(duì)氣候變化,搶占發(fā)展低碳經(jīng)濟(jì)的有利地位,國際上興起了低碳立法的熱潮!堵(lián)合國氣候變化框架公約》等應(yīng)對(duì)氣候變化、促進(jìn)低碳發(fā)展的公約、條約應(yīng)運(yùn)而生。國際標(biāo)準(zhǔn)化組織(ISO)等國際組織及民間機(jī)構(gòu)不斷加強(qiáng)碳足跡、碳認(rèn)證等低碳標(biāo)準(zhǔn)的研究與制定。許多國家、尤其是發(fā)達(dá)國家的低碳法律體系日漸健全。國際低碳立法對(duì)各國經(jīng)濟(jì)社會(huì)以及貿(mào)易發(fā)展的影響將越來越大。中國作為世界第二大經(jīng)濟(jì)體、第一大貨物貿(mào)易國以及第一大碳排放國,將首當(dāng)其沖。雖然我國在低碳立法方面已經(jīng)取得了一些進(jìn)展,但仍然存在基本法缺位、法律體系不完善、立法理念滯后等不足,難以適應(yīng)我國應(yīng)對(duì)氣候變化以及經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展的需要。因此,研究、借鑒國際低碳立法經(jīng)驗(yàn),推進(jìn)我國低碳立法的理論研究及立法實(shí)踐,無疑對(duì)我國應(yīng)對(duì)氣候變化、促進(jìn)和保障經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展具有十分重要的意義。本文從國際法視角,運(yùn)用比較法等研究方法,對(duì)國際低碳立法、低碳標(biāo)準(zhǔn)以及中國低碳立法相關(guān)問題進(jìn)行研究與分析,并借鑒國際經(jīng)驗(yàn),立足國情,對(duì)我國低碳立法提出了具體建議。本文內(nèi)容共包括六章。第1章為引言,對(duì)論文的選題背景、研究意義、國內(nèi)外研究綜述以及研究思路、內(nèi)容和方法進(jìn)行了闡述,并指出了論文的主要?jiǎng)?chuàng)新與不足之處。第2章在厘清低碳立法相關(guān)概念的基礎(chǔ)上,對(duì)我國低碳立法的法學(xué)理論基礎(chǔ)、現(xiàn)實(shí)意義進(jìn)行了分析與闡述。第3章從立法原則、取向等方面對(duì)國際低碳立法進(jìn)行了比較研究,評(píng)價(jià)了其對(duì)我國低碳立法的借鑒價(jià)值和啟示。第4章對(duì)國際低碳標(biāo)準(zhǔn)進(jìn)行了比較研究,評(píng)價(jià)了其對(duì)我國低碳標(biāo)準(zhǔn)建設(shè)以及爭取國際低碳標(biāo)準(zhǔn)話語權(quán)的啟示。第5章對(duì)我國低碳立法的必要性及其原則進(jìn)行了分析和論述。第6章在對(duì)我國原有低碳相關(guān)立法進(jìn)行梳理的基礎(chǔ)上,立足國情,提出了我國低碳立法的具體建議。此外,還附上了《低碳發(fā)展法》建議稿。
[Abstract]:In recent years, climate change has become a major global issue of universal concern to the international community. To deal with climate change and control carbon emissions has become an important part of international negotiations and cooperation. In order to cope with climate change and seize the favorable position of developing low carbon economy, there has been an upsurge of low carbon legislation in the world. The United Nations Framework Convention on Climate change and other conventions dealing with climate change and promoting low carbon development have emerged as the times require. International organizations and private organizations such as ISO (International Organization for Standardization) continue to strengthen the research and formulation of low carbon standards such as carbon footprint and carbon certification. Many countries, especially developed countries, are improving their low-carbon legal systems. International low-carbon legislation will have an increasing impact on the economic, social and trade development of countries. China will be the world's second largest economy, the largest cargo trader and the largest carbon emitter. Although China has made some progress in low-carbon legislation, there are still some deficiencies, such as the absence of basic law, imperfect legal system and lagging legislative ideas, which are difficult to adapt to the needs of climate change and sustainable economic and social development in China. Therefore, it is of great significance for our country to study the theory and practice of low-carbon legislation for reference of international low-carbon legislation experience and to promote and guarantee the sustainable development of economy and society. This paper, from the perspective of international law and using comparative law and other research methods, studies and analyzes the issues related to international low-carbon legislation, low-carbon standards and China's low-carbon legislation, and draws lessons from international experience and bases itself on national conditions. Some suggestions on low-carbon legislation in China are put forward. This paper consists of six chapters. The first chapter is the introduction, which describes the background, significance, domestic and foreign research review, research ideas, contents and methods, and points out the main innovations and shortcomings of the paper. Chapter 2, on the basis of clarifying the related concepts of low-carbon legislation, analyzes and expounds the theoretical basis and practical significance of low-carbon legislation in China. Chapter 3 makes a comparative study on the international low-carbon legislation from the aspects of legislative principle and orientation, and evaluates its reference value and enlightenment to China's low-carbon legislation. Chapter 4 makes a comparative study on the international low carbon standard and evaluates its enlightenment to the construction of low carbon standard in China and the right to speak for international low carbon standard. Chapter 5 analyzes and discusses the necessity and principle of low-carbon legislation in China. Chapter 6, on the basis of combing the existing low-carbon legislation in China, puts forward some specific suggestions on low-carbon legislation in China based on the national conditions. In addition, a proposal for the low-carbon Development Law has been attached.
