【摘要】：全球氣候變化引起的溫室效應對全球經(jīng)濟和生態(tài)安全的威脅促使各國轉型于低碳排放、低能源資源消耗、低污染的經(jīng)濟發(fā)展模式。低碳經(jīng)濟實質上是通過減緩溫室效應的發(fā)生以促進經(jīng)濟持續(xù)發(fā)展,以實現(xiàn)經(jīng)濟發(fā)展與環(huán)境社會效益相互平衡的協(xié)調發(fā)展狀態(tài)。哥本哈根氣候大會使氣候問題倍受關注,世界發(fā)達國家均對現(xiàn)代工業(yè)發(fā)展所引起的氣候變化——溫室效應所帶來的嚴重后果從國家層面進行應對。 中國是世界溫室氣體排放大國,逐步降低排放、發(fā)展低碳經(jīng)濟是必然的選擇。從發(fā)達國家低碳經(jīng)濟理論與實踐發(fā)展來看,我國低碳經(jīng)濟相關實踐與法律仍處于探索階段。然而由于低碳經(jīng)濟的公共特性,市場調控容易失靈,容易產(chǎn)生政府調控下的負外部性等問題。在促進低碳經(jīng)濟發(fā)展的同時,必須加強低碳經(jīng)濟立法,抑制市場失靈和負外部性等問題對發(fā)展低碳經(jīng)濟帶來的負面效應。 本文通過對低碳經(jīng)濟的內(nèi)涵界定和國際社會應對全球氣候變化措施的分析,以及世界發(fā)達國家在全球氣候變化前提下發(fā)展低碳經(jīng)濟的立法情況進行比較,提出在我國經(jīng)濟發(fā)展中應立法構建我國低碳經(jīng)濟法律體系,建立配套的法律制度。本文擬從以下幾個部分對其進行研究探討。 第一部分是低碳經(jīng)濟立法基本理論分析。對于低碳經(jīng)濟來說,以社會本位為出發(fā)點的價值理念的實現(xiàn),有賴于低碳經(jīng)濟法律保障制度的建立和發(fā)展。剖析低碳經(jīng)濟的內(nèi)涵,明確低碳經(jīng)濟與循環(huán)經(jīng)濟的異同,有助于厘清對兩者的誤解,更好的推動兩者的協(xié)同發(fā)展,實現(xiàn)經(jīng)濟社會全面的可持續(xù)發(fā)展,有利于相關法律制度的構建。同時低碳經(jīng)濟的公共特性,也使得政府對經(jīng)濟的調控顯得更為迫切,客觀上需要制定與之對應的低碳經(jīng)濟法律法規(guī),以此來消除或抑制、減少外部性帶來的負面效應。從政府干預經(jīng)濟的角度論述了加強我國低碳經(jīng)濟立法的理論基礎。 第二部分采用實證分析的方法介紹了規(guī)制全球性氣候變化的國際公約和世界各國的立法措施。通過分析英美德日等國的立法實踐及其特征,指出國際立法實踐對我國的低碳經(jīng)濟立法的啟示作用和借鑒意義。 第三部分闡述了我國低碳經(jīng)濟發(fā)展的立法現(xiàn)狀。面對世界性的低碳發(fā)展,我國政府在國家的發(fā)展戰(zhàn)略中突出了低碳經(jīng)濟的重要位置,政府也明確了在推動低碳經(jīng)濟發(fā)展中應承擔的義務。與外國經(jīng)濟發(fā)達國家相比較,我國相關立法闕如,仍存在諸多問題。通過分析我國低碳經(jīng)濟立法中存在的問題,指出在未來的國家立法中應借鑒西方發(fā)達國家的立法經(jīng)驗,并結合我國的實際情況制定低碳經(jīng)濟法律法規(guī),構建相關配套法律制度。 第四部分從立法的角度對構建低碳經(jīng)濟法律制度提出建議,借鑒并結合我國實際情況,采用適當?shù)牧⒎Ｊ?適時制定《低碳經(jīng)濟促進法》等法律,并著重就碳稅、排放權交易、碳金融等制度進行論述。提出借鑒西方國家的經(jīng)驗并結合我國實際構建這些促進經(jīng)濟低碳發(fā)展的制度的設想。
[Abstract]:The global economic and ecological security threats caused by global climate change threaten to transform countries into low - carbon emissions , low - energy resource consumption and low - pollution modes of economic development . The low - carbon economy is in essence by slowing the occurrence of greenhouse effects in order to achieve a balanced development of economic development and environmental social benefits .


In the light of the low - carbon economy theory and practice development in developed countries , China ' s low - carbon economy - related practice and law are still in the exploration stage . However , because of the public characteristics of low - carbon economy , market regulation is easy to fail , it is easy to generate the negative external nature of government regulation . At the same time , it is necessary to strengthen the low - carbon economic legislation , restrain market failure and negative external sex , and to develop the negative effect of low - carbon economy .


By comparing the definition of low - carbon economy and the analysis of international community ' s response to global climate change , and comparing the legislation of developing low - carbon economy under the precondition of global climate change , this paper puts forward that legislation should be set up in our country ' s economic development .


The first part is the basic theoretical analysis of the low - carbon economy legislation . For the low - carbon economy , the realization of the value idea based on the social standard depends on the establishment and development of the low - carbon economy legal safeguard system . It is helpful to clarify the connotation of the low - carbon economy , clear the similarities and differences between the low - carbon economy and the circular economy , and help to clarify the negative effects of low - carbon economy .


The second part introduces the international conventions on global climate change and the legislative measures of the world ' s countries by means of empirical analysis . By analyzing the legislative practice and the characteristics of Anglo - American countries , the author points out that the international legislation practice has an inspiration to China ' s low - carbon economic legislation .


In the third part , the current situation of China ' s low - carbon economic development is described . In the face of the world ' s low - carbon development , our government has highlighted the important position of low - carbon economy in the country ' s development strategy .


The fourth part , from the angle of legislation , puts forward some suggestions on the construction of low - carbon economic legal system , draws lessons from and combines with the actual situation of our country , adopts the appropriate legislation mode , develops the legislation of promoting the low - carbon economic promotion law , and discusses the carbon tax , the trading of emission right and the carbon finance , and puts forward the idea of drawing on the experience of western countries and building these systems for promoting the low - carbon development of the economy .
