【摘要】： 從上世紀(jì)五、六十年代開始,為了解決環(huán)境問題,使經(jīng)濟與環(huán)境協(xié)調(diào)發(fā)展,一些經(jīng)濟發(fā)達國家開始從環(huán)境保護產(chǎn)業(yè)方面入手,通過建立和發(fā)展環(huán)保產(chǎn)業(yè),以實現(xiàn)對環(huán)境問題的“源頭控制”和“全過程控制”。在此背景下,本文以環(huán)保產(chǎn)業(yè)的產(chǎn)生和發(fā)展與環(huán)境法律制度的完善為主要研究對象,主要是對在市場化條件下,環(huán)保產(chǎn)業(yè)產(chǎn)生和發(fā)展的必要性和可行性進行分析和論證,進而對環(huán)境法律制度針對環(huán)保產(chǎn)業(yè)所需進行的調(diào)整和改變做一些理論上的探討和研究。 在論證環(huán)保產(chǎn)業(yè)發(fā)展中的政府責(zé)任以及厘清排污主體和治污主體的關(guān)系的基礎(chǔ)上,本文進一步分析環(huán)保產(chǎn)業(yè)發(fā)展對環(huán)境法律制度新需求的理論原因,其在于:經(jīng)濟基礎(chǔ)決定法律發(fā)展、環(huán)境責(zé)任原則以及市場失靈和政府失靈。由此得出完善與環(huán)保產(chǎn)業(yè)相關(guān)的、最重要的環(huán)境法律制度,即環(huán)境資源財產(chǎn)權(quán)制度,其中重點是環(huán)境使用權(quán)制度;環(huán)境標(biāo)準(zhǔn)制度;環(huán)境行政合同制度。 總之,本文試圖構(gòu)建這樣的理論體系,即在行政主體、排污主體和治污主體的三角關(guān)系中,環(huán)境資源財產(chǎn)權(quán)制度和環(huán)境標(biāo)準(zhǔn)制度是兩塊基石,環(huán)境合同制度是核心,行政主體是規(guī)則制定者,真正背后力量是環(huán)保產(chǎn)業(yè)的發(fā)展。這些因素的綜合作用必將導(dǎo)致環(huán)境保護法律責(zé)任的間接化和社會化,必然有效增強環(huán)境法的復(fù)合性與包容性及其對市場機制的適應(yīng)性。
[Abstract]:Since the 1950s and 1960s, in order to solve environmental problems and coordinate economic and environmental development, some economically developed countries have started from the aspect of environmental protection industries, through the establishment and development of environmental protection industries. In order to achieve "source control" and "whole process control" of environmental problems. In this context, this paper takes the emergence and development of environmental protection industry and the improvement of environmental legal system as the main research object, mainly analyzes and demonstrates the necessity and feasibility of the emergence and development of environmental protection industry under the condition of marketization. Then it makes some theoretical discussion and research on the adjustment and change of the environmental legal system in view of the environmental protection industry. On the basis of demonstrating the government responsibility in the development of environmental protection industry and clarifying the relationship between the main body of sewage discharge and the subject of pollution control, this paper further analyzes the theoretical reasons for the new demand of environmental protection industry development for the environmental legal system. It lies in: the economic basis determines the legal development, the principle of environmental responsibility and market failure and government failure. It is concluded that the most important environmental legal system related to environmental protection industry is the system of environmental resource property right, in which the emphasis is on the system of environmental right to use; the system of environmental standards; and the system of environmental administrative contract. In a word, this paper tries to construct such a theoretical system, that is, in the triangular relationship among administrative subject, pollutant discharge subject and pollution control subject, the system of environmental resource property right and environmental standard system are the two cornerstones, and the environmental contract system is the core. The administrative subject is the rule maker, and the real force behind it is the development of the environmental protection industry. The comprehensive action of these factors will lead to the indirect and socialization of the legal responsibility of environmental protection, which will enhance the compounding and inclusiveness of environmental law and its adaptability to the market mechanism.
