【摘要】: 加強(qiáng)海洋環(huán)境行政法律責(zé)任歸責(zé)原則的研究,就是為了進(jìn)一步完善海洋環(huán)境行政法律責(zé)任的追究機(jī)制,更好的來彌補(bǔ)歸責(zé)原則研究的缺失給海洋環(huán)境保護(hù)法帶來的某些事實(shí)缺憾。在進(jìn)一步整合歸責(zé)原則研究的合理性和共識(shí)性成果的基礎(chǔ)上,嘗試提出一個(gè)關(guān)于海洋環(huán)境行政法律責(zé)任歸責(zé)原則框架,并以此為據(jù)對海洋環(huán)境行政法律責(zé)任等基本問題進(jìn)行重新思考。 以我國海洋環(huán)境保護(hù)法律體系為參照系,從海洋環(huán)境法律責(zé)任自身的特殊性視角,將海洋環(huán)境行政法律責(zé)任作為一個(gè)獨(dú)立的責(zé)任體系加以研究,對比其它法律責(zé)任的共同性和差異性來探求海洋環(huán)境行政法律責(zé)任的內(nèi)在規(guī)律,對海洋環(huán)境行政法律責(zé)任進(jìn)行一次系統(tǒng)的梳理和歸納,從而探尋論證海洋環(huán)境行政法律責(zé)任歸責(zé)原則的基本范疇。本文主要介紹分析海洋環(huán)境行政法律責(zé)任歸責(zé)原則的基本范疇,理清了海洋環(huán)境行政法律責(zé)任的概念,分析其歷史發(fā)展過程,進(jìn)而對此作出價(jià)值分析。同時(shí)考察了各種歸責(zé)原則學(xué)說提出的理論背景和適用條件,客觀分析各種學(xué)說的優(yōu)缺點(diǎn)。結(jié)合我國海洋環(huán)境行政法律責(zé)任制度的現(xiàn)狀及其存在問題,提出相應(yīng)的完善對策或建議,探尋我國海洋環(huán)境行政法律責(zé)任歸責(zé)原則的模式選擇。 無論采用何種歸責(zé)原則都應(yīng)符合海洋環(huán)境保護(hù)法的實(shí)際情況、適合海洋環(huán)境監(jiān)督管理發(fā)展的特殊需要。我國的現(xiàn)實(shí)情況決定了應(yīng)當(dāng)針對不同類型的海洋環(huán)境行政法律責(zé)任形式確立不同的歸責(zé)原則,建立一個(gè)包括過錯(cuò)、違法、危險(xiǎn)責(zé)任原則在內(nèi)的多元化歸責(zé)體系較為科學(xué)。我國海洋環(huán)境行政法律責(zé)任歸則原則主要有三個(gè),即過錯(cuò)責(zé)任原則、違法責(zé)任原則和危險(xiǎn)責(zé)任原則。其中過錯(cuò)責(zé)任原則是適用于一般海洋環(huán)境污染或生態(tài)破壞行為的一項(xiàng)基本歸責(zé)原則,其他兩個(gè)原則是為了彌補(bǔ)過錯(cuò)責(zé)任原則不足而產(chǎn)生的兩個(gè)輔助性原則,這兩個(gè)輔助性原則適用范圍是有限的,都有各自的適用范圍。
[Abstract]:The purpose of strengthening the research on the principle of imputation of legal liability for marine environment administration is to further improve the investigation mechanism of administrative legal liability of marine environment.Better to make up for the lack of imputation principle to the marine environmental protection law.And on the basis of this as the basis of the marine environment administrative legal responsibility and other basic issues to be reconsidered.Taking the legal system of marine environmental protection in China as a reference system, this paper studies the administrative legal liability of marine environment as an independent liability system from the perspective of the particularity of the legal responsibility of the marine environment.Comparing with the commonality and difference of other legal responsibilities, this paper probes into the inherent law of the administrative legal liability of the marine environment, and systematically combs and sums up the legal liability of the administrative law of the marine environment.In order to explore the basic category of legal liability of marine environment administrative liability.At the same time, the theoretical background and applicable conditions of various theories of imputation principle are investigated, and the advantages and disadvantages of these theories are analyzed objectively.No matter what kind of imputation principle is adopted, it should conform to the actual situation of marine environmental protection law and be suitable for the special needs of the development of marine environment supervision and management.The reality of our country determines that we should establish different imputation principles for different types of administrative legal liability of marine environment, and establish a multi-liability system which includes fault, illegal and dangerous liability principle.There are three principles for the legal liability of marine environment in China, namely, fault liability, illegal liability and dangerous liability.The scope of application of these two auxiliary principles is limited and each has its own scope of application.
