【摘要】： 環(huán)境產(chǎn)業(yè)是伴隨著全球環(huán)境保護(hù)意識(shí)的增強(qiáng)和各國(guó)可持續(xù)發(fā)展戰(zhàn)略的實(shí)施而出現(xiàn)的一門(mén)新興產(chǎn)業(yè)。目前,它在國(guó)際產(chǎn)業(yè)領(lǐng)域已經(jīng)和通訊技術(shù)產(chǎn)業(yè)(IT)、生物醫(yī)療產(chǎn)業(yè)一同成為并駕齊驅(qū)的三大產(chǎn)業(yè),被世界公認(rèn)為21世紀(jì)最具發(fā)展?jié)摿Φ摹俺?yáng)產(chǎn)業(yè)”。因此,大力發(fā)展環(huán)境產(chǎn)業(yè)在當(dāng)今世界各國(guó)已是不爭(zhēng)的事實(shí)和歷史的必然。 在中國(guó),環(huán)境產(chǎn)業(yè)是全面建設(shè)小康社會(huì)過(guò)程中最具生機(jī)與活力的產(chǎn)業(yè),它的發(fā)展必將促進(jìn)我國(guó)環(huán)境保護(hù)事業(yè)更好更快的發(fā)展。為此,在今后的環(huán)境保護(hù)過(guò)程中,我國(guó)必須遵循可持續(xù)發(fā)展戰(zhàn)略和循環(huán)經(jīng)濟(jì)理念,推行市場(chǎng)化的環(huán)境保護(hù)和生態(tài)建設(shè)的運(yùn)作方式,利用市場(chǎng)機(jī)制,發(fā)揮政府調(diào)控作用,調(diào)整產(chǎn)品結(jié)構(gòu),依靠科學(xué)技術(shù),制定相應(yīng)的法律政策,綜合運(yùn)用政治、經(jīng)濟(jì)和法律的手段,全面推進(jìn)環(huán)境產(chǎn)業(yè)的快速、健康的發(fā)展。 眾所周知,環(huán)境產(chǎn)業(yè)是一種“法律、政策引導(dǎo)型產(chǎn)業(yè)”,它的興起與發(fā)展離不開(kāi)法律機(jī)制的驅(qū)動(dòng)。實(shí)踐證明,法律、政策及其執(zhí)行情況對(duì)環(huán)境產(chǎn)業(yè)的發(fā)展起著決定性的作用。特別在環(huán)境產(chǎn)業(yè)的發(fā)展初期,法律制度是其產(chǎn)生和存在的基礎(chǔ),它直接影響著一國(guó)環(huán)境產(chǎn)業(yè)的發(fā)展水平和進(jìn)程,是市場(chǎng)經(jīng)濟(jì)條件下發(fā)展環(huán)境產(chǎn)業(yè)的重要制度保障。由此可見(jiàn),完善環(huán)境保護(hù)法律制度,構(gòu)建環(huán)境產(chǎn)業(yè)法律體系,對(duì)我國(guó)大力發(fā)展環(huán)境產(chǎn)業(yè)都具有深遠(yuǎn)的意義。本文從環(huán)境產(chǎn)業(yè)的概念入手,總結(jié)了國(guó)外典型國(guó)家在環(huán)境產(chǎn)業(yè)及其法制建設(shè)方面的成功經(jīng)驗(yàn),研究了我國(guó)在這兩個(gè)方面的發(fā)展現(xiàn)狀,比較分析了中國(guó)和西方發(fā)達(dá)國(guó)家在環(huán)境產(chǎn)業(yè)及其法律制度建設(shè)方面的差距,立足于本國(guó)經(jīng)濟(jì)發(fā)展和環(huán)境保護(hù)的基本國(guó)情,以我國(guó)現(xiàn)行的環(huán)境保護(hù)基本法為依托,有選擇的借鑒了國(guó)外發(fā)展的成功經(jīng)驗(yàn),對(duì)構(gòu)建我國(guó)環(huán)境產(chǎn)業(yè)法律體系進(jìn)行了框架性思考,旨在發(fā)揮法律、政策對(duì)環(huán)境產(chǎn)業(yè)發(fā)展的促進(jìn)作用,以期起到拋磚引玉之效,推動(dòng)我國(guó)環(huán)境產(chǎn)業(yè)及其法律制度建設(shè)的完善和順利發(fā)展,并最終實(shí)現(xiàn)我國(guó)資源、環(huán)境、經(jīng)濟(jì)和人類社會(huì)的和諧、統(tǒng)一、可持續(xù)的發(fā)展。
[Abstract]:Environmental industry is a new industry emerging with the enhancement of global environmental protection consciousness and the implementation of sustainable development strategy in various countries.At present, it has become one of the three industries in the international industry, along with the communication technology industry and the biomedical industry, and has been recognized as the "sunrise industry" with the greatest development potential in the 21st century.Therefore, it is an indisputable fact and historical necessity to develop environmental industry in the world.In China, environmental industry is the most vital and dynamic industry in the process of building a well-off society in an all-round way, and its development will promote the development of environmental protection in China better and faster.Therefore, in the process of environmental protection in the future, our country must follow the strategy of sustainable development and the concept of circular economy, carry out the operation mode of market-oriented environmental protection and ecological construction, make use of the market mechanism, and give full play to the role of government regulation and control.Adjusting the product structure, relying on science and technology, making corresponding legal policies, synthetically using political, economic and legal means to promote the rapid and healthy development of environmental industry in an all-round way.As we all know, environmental industry is a kind of "law, policy leading industry", and its rise and development can not be separated from the drive of legal mechanism.Practice has proved that laws, policies and their implementation play a decisive role in the development of environmental industry.Especially in the early stage of the development of environmental industry, the legal system is the basis of its emergence and existence, which directly affects the development level and process of a country's environmental industry, and is an important institutional guarantee for the development of environmental industry under the condition of market economy.It can be seen that perfecting the legal system of environmental protection and constructing the legal system of environmental industry are of far-reaching significance to the development of environmental industry in China.Starting with the concept of environmental industry, this paper summarizes the successful experiences of typical foreign countries in environmental industry and its legal system construction, and studies the present situation of our country's development in these two aspects.This paper compares and analyzes the gap between China and western developed countries in the construction of environmental industry and its legal system, based on the basic conditions of economic development and environmental protection in China, and relies on the basic law of environmental protection in China.In order to give full play to the role of law and policy in promoting the development of environmental industry, the author draws lessons from the successful experience of foreign countries, and makes a frame thinking on the construction of the legal system of environmental industry in China, in order to promote the development of environmental industry.Promote the perfect and smooth development of our country's environmental industry and its legal system construction, and finally realize the harmonious, unified and sustainable development of our country's resources, environment, economy and human society.
