【摘要】：國有林是我國經(jīng)濟(jì)社會(huì)發(fā)展的戰(zhàn)略資源,國有林法律管理是我國現(xiàn)代林業(yè)建設(shè)的重要內(nèi)容。雖然我國國有林法律管理經(jīng)過長期發(fā)展取得了較大成功,但經(jīng)營管理體制不順、行政過多干預(yù)國有林管理等弊端積重難返,已經(jīng)嚴(yán)重制約了國有林的可持續(xù)發(fā)展。建立健全國有林法律管理制度是國有林適應(yīng)社會(huì)主義市場經(jīng)濟(jì)體制的重要保障。本文從構(gòu)建缺失的國有林法律管理制度及提出完善現(xiàn)有法律制度對策兩個(gè)方面進(jìn)行研究,為實(shí)現(xiàn)國有林可持續(xù)經(jīng)營與科學(xué)管理、適應(yīng)市場經(jīng)濟(jì)運(yùn)行環(huán)境下對國有森林資源的要求,促進(jìn)傳統(tǒng)林業(yè)向現(xiàn)代林業(yè)的跨越式發(fā)展,提供理論支撐。 本文所定義的國有林法律管理是指在國有林可持續(xù)經(jīng)營與管護(hù)活動(dòng)中,從事國有林經(jīng)營與管護(hù)的國家機(jī)構(gòu)、國有企業(yè)及其他經(jīng)濟(jì)組織和個(gè)人依據(jù)我國《森林法》等國有林法律法規(guī)體系所賦予的權(quán)力與職責(zé)、權(quán)利與義務(wù)對涉及國有林可持續(xù)經(jīng)營與管護(hù)的人力、物力與財(cái)力及其他資源進(jìn)行協(xié)調(diào)或處理,以達(dá)到實(shí)現(xiàn)現(xiàn)代林業(yè)的活動(dòng)過程。 第一,梳理了我國國有林法律管理制度的演進(jìn)脈絡(luò),發(fā)現(xiàn)林業(yè)法律、法規(guī)在我國國有林法律管理中一直占據(jù)著非常重要的地位。同時(shí),雖歷經(jīng)演變,但我國目前的國有林法律管理制度依然存在：相關(guān)制度設(shè)計(jì)存在局限性、相關(guān)法律制度欠缺、相關(guān)法律規(guī)范存在沖突、國有林發(fā)展的立法理念亟待確立及制度有效實(shí)施的保障機(jī)制不健全等問題,客觀上阻礙了我國國有林的經(jīng)營管理與保護(hù)及國有林區(qū)經(jīng)濟(jì)的可持續(xù)發(fā)展。 第二,運(yùn)用模糊綜合聚類等定量分析方法對國有林法律管理制度的實(shí)施效果進(jìn)行評價(jià)及對缺失原因進(jìn)行分析。研究表明：影響國有林法律管理制度實(shí)施效果主要是五大類因素；導(dǎo)致國有林法律管理制度缺失則主要在于國有林法律管理制度供給不足、國有林法律管理制度的路徑依賴以及國有林法律管理制度有效需求不足等方面原因。在此基礎(chǔ)上,本文提出從構(gòu)建欠缺的國有林法律制度、完善現(xiàn)有的法律制度兩個(gè)方面以建立健全我國國有林法律管理的制度體系,形成了本論文重要的研究結(jié)論與創(chuàng)新主體。 第三,提出了國有林法律管理制度缺失的立法體系。制定《國有林經(jīng)營管理法》,提出其應(yīng)以生態(tài)效益優(yōu)先為價(jià)值引領(lǐng),涵蓋國有林經(jīng)營管理、風(fēng)險(xiǎn)防范、經(jīng)濟(jì)激勵(lì)、法律責(zé)任制度等主要內(nèi)容；制定《森林資源資產(chǎn)評估法》,提出其應(yīng)該以誠信原則等為基本指導(dǎo),以國有林評估監(jiān)督管理、資產(chǎn)評估準(zhǔn)則、市場準(zhǔn)入等制度為主要內(nèi)容；制定《森林保險(xiǎn)法》,提出其應(yīng)以促進(jìn)森林保險(xiǎn)事業(yè)的可持續(xù)發(fā)展為價(jià)值取向,以近因與公平競爭等為基本原則,包括政策性森林保險(xiǎn)、專項(xiàng)基金與保險(xiǎn)訴訟時(shí)效等制度為主要內(nèi)容。 第四,提出了完善我國國有林經(jīng)營管理具體法律制度的對策建議。主要包括：建立跨部門的國有林調(diào)查與監(jiān)測體制；明晰國家職能、健全國有林地所有權(quán)、國有林下資源歸屬權(quán)制度；健全與完善國有林用益權(quán)與流轉(zhuǎn)法律制度、完善國有林擔(dān)保物權(quán)制度、健全國有林權(quán)屬登記制度；完善生態(tài)效益補(bǔ)償制度等。 第五,提出了國有林法律管理制度有效實(shí)施的配套保障機(jī)制：公正的糾紛解決機(jī)制及廣泛的公眾參與機(jī)制、民主決策機(jī)制和有力的執(zhí)行機(jī)制、完善協(xié)調(diào)機(jī)制和構(gòu)建有力的行政監(jiān)督機(jī)制、強(qiáng)有力的社會(huì)監(jiān)督機(jī)制等。 建立健全國有林法律管理制度是一項(xiàng)艱巨、漫長的系統(tǒng)工程。隨著社會(huì)的不斷發(fā)展與進(jìn)步,法律法規(guī)條款的建立與完善是一個(gè)必然的過程,本文的研究有助于彌補(bǔ)我國現(xiàn)階段森林法律體系中有關(guān)國有林經(jīng)營管理制度的缺陷與不足,為促進(jìn)國有森林資源依法持續(xù)、科學(xué)的發(fā)展,提高政府部門管理國有森林資源的效率,實(shí)現(xiàn)對國有林的規(guī)范、高效管理提供理論支撐。
[Abstract]:The state - owned forest is the strategic resource of our country ' s economic and social development , the state - owned forest legal management is the important content of the construction of modern forestry in our country .


The state - owned forest legal management defined in this paper refers to the state institutions , state - owned enterprises and other economic organizations and individuals engaged in the state - owned forest management and management in the state - owned forest sustainable management and management activities . The power and duties , rights and obligations of the state - owned forest laws and regulations related to the sustainable management and management of the state - owned forest are coordinated or treated with the manpower , material and financial resources and other resources related to the sustainable management and management of the state - owned forest , so as to achieve the activity process of realizing modern forestry .


First , combing the evolution of the legal system of state - owned forest in China , it is found that the laws and regulations of forestry always occupy a very important position in the legal management of state - owned forest in China . At the same time , the current state - owned forest legal management system still exists in our country . At the same time , the current state - owned forest legal management system still exists : the limitation of the relevant system design , the lack of relevant legal system , the absence of relevant legal norms , the lack of sound security mechanism of the state - owned forest development , and the sustainable development of the state - owned forest region economy .


Secondly , the implementation effect of the state - owned forest legal management system is evaluated and analyzed by means of quantitative analysis methods such as fuzzy comprehensive clustering . The research shows that the effect of influencing state - owned forest legal management system is mainly five major factors ;
The lack of legal management system of state - owned forest mainly lies in the inadequate supply of state - owned forest legal management system , the path dependence of state - owned forest legal management system and the insufficient effective demand of state - owned forest legal management system .


Thirdly , this paper puts forward the legislative system of the lack of legal management system of state - owned forest . The author puts forward that it should take the priority of ecological benefit as the value leading , covering the main contents of state - owned forest management , risk prevention , economic incentive and legal liability system .
Establish the appraisal method of forest resources assets appraisal , and put forward that it should be guided by the principle of good faith and so on , with the system of state - owned forest valuation supervision and administration , asset appraisal criterion and market access , etc .
In order to promote the sustainable development of forest insurance , the author puts forward that it should focus on the sustainable development of forest insurance cause , including policy forest insurance , special fund and limitation of insurance litigation , etc .


Fourthly , it puts forward the countermeasures and suggestions to perfect the specific legal system of the management and management of state - owned forest in China , including : establishing cross - sectoral state - owned forest investigation and monitoring system ;
Clear the functions of the country , strengthen the ownership of the forest land in the country and the system of the return of the resources under the state - owned forest ;
Perfect and perfect state - owned forest benefit right and circulation legal system , perfect state - owned forest security right system , perfect state - owned forest ownership registration system ;
Perfect ecological benefit compensation system and so on .


Fifth , the paper puts forward the supporting mechanism of effective implementation of the state - owned forest legal management system : the fair dispute settlement mechanism and the broad public participation mechanism , the democratic decision - making mechanism and the powerful implementation mechanism , perfect the coordination mechanism and build strong administrative supervision mechanism , strong social supervision mechanism , etc .


The establishment and perfection of state - owned forest legal management system is an arduous and long system engineering . With the development and progress of society , the establishment and perfection of laws and regulations are a necessary process . The research of this paper will help to make up for the deficiencies and shortcomings of the management system of state - owned forest in our country ' s current forest legal system . In order to promote the sustainable and scientific development of state - owned forest resources , and to improve the efficiency of government departments to manage the state - owned forest resources , theoretical support is provided for the regulation and efficient management of state - owned forest resources .
