【摘要】： 循環(huán)經(jīng)濟是一種以減量化、再利用、資源化為原則,以資源的節(jié)約和循環(huán)利用為核心,以低消耗、低排放、高效率為基本特征,與可持續(xù)發(fā)展理念相吻合的新型經(jīng)濟發(fā)展模式。傳統(tǒng)經(jīng)濟模式下,生產(chǎn)者的環(huán)境社會責任主要集中在“末端治理”方面,而循環(huán)經(jīng)濟的推行要求生產(chǎn)者對其生產(chǎn)活動進行全盤考慮,即從產(chǎn)品的設(shè)計、原材料的采購、生產(chǎn)過程中、以及產(chǎn)品廢棄物的回收直至最終處置都要關(guān)注對環(huán)境要素的影響。在循環(huán)經(jīng)濟模式下探討生產(chǎn)者的環(huán)境社會責任并以完善的法律制度體系加以規(guī)范就成為必然。 首先,我們要對生產(chǎn)者環(huán)境社會責任予以界定:它是指生產(chǎn)者在追求自身經(jīng)濟效益最大化的同時,在生產(chǎn)的準備階段、生產(chǎn)過程中、產(chǎn)品的銷售階段以及產(chǎn)品消費后的廢棄物回收利用階段,對環(huán)境公益的保護和增進義務(wù),即生產(chǎn)者在生產(chǎn)全過程施行環(huán)境行為的第一性義務(wù),包括法律義務(wù)和道德義務(wù)兩個方面的內(nèi)容。其次,我們認為《循環(huán)經(jīng)濟促進法》確認的循環(huán)經(jīng)濟模式與生產(chǎn)者環(huán)境社會責任具有相輔相成的關(guān)系,生產(chǎn)者在循環(huán)經(jīng)濟模式下有責任實行“全過程控制”和保障“清潔生產(chǎn)”。再次,通過對傳統(tǒng)經(jīng)濟模式下我國生產(chǎn)者環(huán)境社會責任制度進行考察,發(fā)現(xiàn)我國傳統(tǒng)生產(chǎn)者環(huán)境社會責任制度的規(guī)定大多缺乏實效且多為“末端治理”的措施,而其根本原因就是環(huán)境法的立法理念受到了傳統(tǒng)發(fā)展觀的不利影響。最后,我們要以循環(huán)經(jīng)濟理念為指導,構(gòu)建以清潔生產(chǎn)為核心的“全過程控制”生產(chǎn)者環(huán)境社會責任制度體系,主要涉及:生產(chǎn)準備階段的綠色設(shè)計和綠色采購制度;生產(chǎn)過程中的綠色生產(chǎn)控制制度和綠色包裝制度;產(chǎn)品銷售環(huán)節(jié)的綠色營銷制度;廢棄物回收處置階段的生產(chǎn)者責任延伸制度及與之配套的環(huán)境押金制度和貫穿“全過程控制”的生產(chǎn)者環(huán)境信息公開制度。
[Abstract]:Under the traditional economic model, the environmental and social responsibility of producers is mainly focused on the "end governance", and the implementation of circular economy requires the producers to consider their production activities comprehensively, that is, from the product design, the purchase of raw materials.In the process of production, as well as the product waste recovery until the final disposal, attention should be paid to the environmental factors.It is inevitable to explore the producer's environmental and social responsibility under the circular economy model and standardize it with a perfect legal system.First of all, we should define the producer's environmental and social responsibility: it refers to the producer in the preparation stage of production, in the process of production, while pursuing the maximum of their own economic benefits.The obligation to protect and promote the environmental public good during the marketing stage of the product and the waste recycling stage after the product consumption, that is, the first obligation of the producer to carry out the environmental behavior in the whole process of production,It includes two aspects: legal obligation and moral obligation.Producers have the responsibility to implement "whole process control" and guarantee "clean production" under circular economy model.Thirdly, by investigating the system of producer environmental social responsibility under the traditional economic model, it is found that most of the regulations of traditional producer environmental social responsibility system are lack of practical effect and are mostly "end governance" measures.The fundamental reason is that the legislative concept of environmental law is adversely affected by the traditional concept of development.Finally, under the guidance of the concept of circular economy, we should construct the system of "whole process control" producer environmental social responsibility system with cleaner production as the core, which mainly involves: green design and green purchasing system in the stage of production preparation;The green production control system and green packaging system in the production process, the green marketing system in the product sale link, the green production control system and the green packaging system in the production process;The extended system of producer responsibility in the stage of waste recovery and disposal, the corresponding environmental deposit system and the open system of producer environmental information through "whole process control".
