【摘要】：聯(lián)合國(guó)氣候變化專門委員會(huì)研究表明，人類在生活和工業(yè)發(fā)展的過(guò)程中向大氣排放的二氧化碳、甲烷等是導(dǎo)致全球溫度升高的主要溫室氣體，其中又以二氧化碳的作用最為顯著。在近一個(gè)世紀(jì)以來(lái)，人類大量使用的礦物燃料是導(dǎo)致了全球變暖的重要原因，隨之而來(lái)的是各種氣候與環(huán)境問(wèn)題，諸如極端天氣頻發(fā)、霧霾對(duì)我國(guó)大部分地區(qū)發(fā)起攻勢(shì)等。在此背景下，人們?cè)噲D通過(guò)經(jīng)濟(jì)發(fā)展方式的改變來(lái)扭轉(zhuǎn)這一狀況繼續(xù)發(fā)展，以低排放、低消耗、低污染為特征的經(jīng)濟(jì)發(fā)展方式——低碳經(jīng)濟(jì)也就順勢(shì)而生了。但是，發(fā)展低碳經(jīng)濟(jì)的資金問(wèn)題，就成為世界各國(guó)政府、國(guó)際組織研究和討論的焦點(diǎn)。這其中較為引人注目的就是國(guó)際性金融機(jī)構(gòu)、銀行等金融系統(tǒng)紛紛涉足低碳經(jīng)濟(jì)領(lǐng)域，使與低碳經(jīng)濟(jì)發(fā)展最為緊密的低碳金融市場(chǎng)紛紛興起。隨后低碳金融法律制度的建立，為低碳經(jīng)濟(jì)的發(fā)展注入了新的活力，并逐漸成為世界各國(guó)搶占低碳經(jīng)濟(jì)發(fā)展制高點(diǎn)的秘密武器。各種服務(wù)于碳排放權(quán)交易的金融法律制度也不斷誕生。為了搶占這一制高點(diǎn)，解決中國(guó)低碳金融法律制度建設(shè)的問(wèn)題就成了焦點(diǎn)。 能源和環(huán)境問(wèn)題已經(jīng)成為困擾我國(guó)經(jīng)濟(jì)發(fā)展的突出問(wèn)題，而低碳經(jīng)濟(jì)的發(fā)展，則可以很好的解決這一問(wèn)題，一方面可以解決中國(guó)經(jīng)濟(jì)發(fā)展所面臨的高排放、高污染、高能耗問(wèn)題；另一方面，可以促進(jìn)中國(guó)產(chǎn)業(yè)結(jié)構(gòu)的轉(zhuǎn)型升級(jí)。然而低碳經(jīng)濟(jì)的發(fā)展需要強(qiáng)有力的資金支持，金融支持就成為必要，但是如果沒(méi)有法律制度為金融支持低碳經(jīng)濟(jì)來(lái)保駕護(hù)航的話，實(shí)現(xiàn)低碳經(jīng)濟(jì)的發(fā)展和產(chǎn)業(yè)升級(jí)轉(zhuǎn)型將成為空談。本文通過(guò)運(yùn)用綜合分析，，總結(jié)歸納、文獻(xiàn)研究等多種方法對(duì)國(guó)內(nèi)外現(xiàn)有的低碳金融法律制度進(jìn)行研究，發(fā)現(xiàn)我國(guó)在低碳金融法制方面的不足，主要表現(xiàn)在現(xiàn)有的立法層次較低，效力不強(qiáng)，很多是原則性規(guī)定，缺乏操作性。因而本文認(rèn)為，我國(guó)應(yīng)借鑒國(guó)外先進(jìn)經(jīng)驗(yàn)，為我國(guó)設(shè)計(jì)構(gòu)建一部以全面、協(xié)調(diào)、可持續(xù)發(fā)展為指導(dǎo)理念、以公平、生態(tài)效益優(yōu)先、政府調(diào)控與市場(chǎng)機(jī)制并重為基本原則的低碳金融基本法，為我國(guó)低碳金融的長(zhǎng)足發(fā)展奠定扎實(shí)的制度基礎(chǔ)。
[Abstract]:The United Nations Intergovernmental Panel on climate change research shows that human emissions to the atmosphere in the process of life and industrial development in carbon dioxide, methane and other greenhouse gases are the main cause of global temperature rise, in which carbon dioxide is the most significant. In nearly a century, a large number of human use of fossil fuels is an important cause the cause of global warming, followed by the various climate and environmental problems, such as frequent extreme weather haze of most of China offensive. Under this background, people have tried to use the economic development mode change to reverse this situation continues to develop, with low emissions, low consumption, low pollution for economic development methods: low carbon economy is homeopathy and health. However, funding the development of low carbon economy, has become the world's governments, the focus of research and discussion of this international organization. One of the more striking is the international financial institutions, banks and other financial systems have been involved in the low carbon economy and low carbon economy development, make the most of low carbon financial market closely. Then have the rise of low carbon finance legal system establishment, has injected new vitality into the development of low-carbon economy, and gradually become a secret weapon countries around the world to seize the commanding heights of the development of low carbon economy. All kinds of services in the carbon emissions trading financial legal system has been born. In order to seize the commanding heights, solve the construction of low-carbon financial legal system China problem has become the focus.
Energy and environmental issues have become a prominent problem in China's economic development, and the development of low carbon economy, can be a good solution to this problem, one can solve the high emissions, facing Chinese economic development of high pollution, high energy consumption problem; on the other hand, can promote the transformation and upgrading of the industrial structure China however, the development of low-carbon economy needs strong financial support, has become the necessary financial support, but if there is no legal system to escort for the financial support of low carbon economy, realize the development of low carbon economy and industrial upgrading and transformation will become empty. In this paper, through comprehensive analysis, summarized research, literature research etc. a variety of domestic and foreign existing low-carbon financial legal system, found the deficiency in our country's low carbon finance legal system, mainly in the existing legislative level is low, effect is not very strong. How is the provisions of principle, lack of maneuverability. Therefore this paper argues that China should learn from foreign advanced experience, to develop a comprehensive coordination for the design of our country, sustainable development as the guide, in a fair, ecological priority, low carbon finance law and government regulation and market mechanism as the basic principle, establish system a solid foundation for the rapid development of low carbon finance in our country.
