【摘要】：近年來(lái),我國(guó)環(huán)保NGO發(fā)展非常迅速,逐漸成為環(huán)保領(lǐng)域內(nèi)比較活躍的主體。面對(duì)我國(guó)嚴(yán)峻的環(huán)境形勢(shì),他們積極開(kāi)展環(huán)�；顒�(dòng)、提供環(huán)境服務(wù),進(jìn)而維護(hù)環(huán)境質(zhì)量和公眾的環(huán)境權(quán)益,促進(jìn)人與自然的和諧,強(qiáng)化其在可持續(xù)發(fā)展進(jìn)程中的作用。然而我國(guó)環(huán)保NGO參與環(huán)境事務(wù)卻遭遇諸多法律困境,不利于其健康發(fā)展及有效參與環(huán)境事務(wù)。本文立足于我國(guó)環(huán)保NGO參與環(huán)境事務(wù)呈現(xiàn)出的“新動(dòng)向與問(wèn)題并存”的現(xiàn)狀,進(jìn)而詳細(xì)分析了其參與環(huán)境事務(wù)所遭遇的法律困境,并提出保障我國(guó)環(huán)保NGO充分有效參與環(huán)境事務(wù)的法律對(duì)策。本文共有五部分： 第一部分討論了環(huán)保NGO的涵義、我國(guó)環(huán)保NGO興起的歷史條件、環(huán)保NGO存在、發(fā)展的理論基礎(chǔ)。 第二部分介紹了我國(guó)環(huán)保NGO參與環(huán)境事務(wù)所呈現(xiàn)出的“新動(dòng)向與問(wèn)題并存”的現(xiàn)狀。 第三部分詳細(xì)地分析了我國(guó)環(huán)保NGO參與環(huán)境事務(wù)所遭遇的法律困境,主要包括：獲取適格主體地位的法律困境、資金保障的法律困境、權(quán)利保障的法律困境、有效監(jiān)管的法律困境。 第四部分對(duì)美國(guó)、英國(guó)、德國(guó)、俄羅斯等部分國(guó)外立法經(jīng)驗(yàn)進(jìn)行考察,以期對(duì)我國(guó)立法者完善相關(guān)法律規(guī)定時(shí)有所借鑒。 第五部分提出了保障我國(guó)環(huán)保NGO有效參與環(huán)境事務(wù)的法律對(duì)策,包括確保環(huán)保NGO簡(jiǎn)便獲得法律主體地位、獲取資金的多重法律保障、保障環(huán)保NGO權(quán)利的法律對(duì)策、健全多元監(jiān)督體制。
[Abstract]:In recent years, China's environmental protection NGO has developed very rapidly and has gradually become a more active subject in the field of environmental protection. In the face of the severe environmental situation in our country, they actively carry out environmental protection activities and provide environmental services. In order to maintain the environmental quality and public environmental rights and interests, promote the harmony between man and nature, and strengthen its role in the process of sustainable development, however, China's environmental protection NGO involved in environmental affairs has encountered many legal difficulties. It is not conducive to its healthy development and effective participation in environmental affairs. This paper is based on the present situation of "new trends and problems" that environmental protection NGO has taken part in environmental affairs, and then analyzes in detail the legal dilemma encountered by its participation in environmental affairs. It also puts forward the legal countermeasures to ensure the full and effective participation of environmental protection NGO in environmental affairs. There are five parts in this paper:. The first part discusses the meaning of environmental protection NGO, the historical conditions of the rise of environmental protection NGO in China, and the theoretical basis of the existence and development of environmental protection NGO. The second part introduces the current situation of environmental protection NGO participating in environmental affairs. The third part analyzes in detail the legal dilemma encountered by environmental protection NGO participating in environmental affairs, including: the legal dilemma of obtaining the status of eligible subject, the legal dilemma of capital guarantee, the legal dilemma of right protection. The legal dilemma of effective supervision. Part 4th examines the legislative experience of some foreign countries, such as the United States, Britain, Germany, Russia and so on, in order to draw lessons from our legislator when perfecting the relevant laws and regulations. In the 5th part, the author puts forward the legal countermeasures to ensure the effective participation of environmental protection NGO in environmental affairs in China, including the legal countermeasures to ensure the environmental protection NGO to obtain the status of legal subject simply, to obtain the multiple legal protection of funds, and to protect the rights of environmental protection NGO. We will improve the pluralistic supervision system.
