【摘要】：礦產(chǎn)資源對(duì)我國(guó)社會(huì)經(jīng)濟(jì)的發(fā)展具有重要作用,而礦產(chǎn)資源的有限性和人類需求的無限性更是要求合理配置礦產(chǎn)資源。礦產(chǎn)資源合理配置的前提是建立礦業(yè)權(quán)流轉(zhuǎn)市場(chǎng),而礦業(yè)權(quán)流轉(zhuǎn)制度是通過礦業(yè)權(quán)流轉(zhuǎn)方式實(shí)現(xiàn)的,因此采礦權(quán)流轉(zhuǎn)方式的完善對(duì)我國(guó)礦業(yè)權(quán)流轉(zhuǎn)市場(chǎng)的建設(shè)具有重要意義。隨著采礦權(quán)流轉(zhuǎn)市場(chǎng)的逐步建立,由于采礦權(quán)流轉(zhuǎn)制度的不成熟,采礦權(quán)的流轉(zhuǎn)在實(shí)踐中產(chǎn)生了諸如非法轉(zhuǎn)讓現(xiàn)象普遍、安全事故頻發(fā)以及環(huán)境破壞嚴(yán)重等問題,要求加強(qiáng)對(duì)采礦權(quán)流轉(zhuǎn)的監(jiān)管。 本文分四個(gè)部分來對(duì)采礦權(quán)流轉(zhuǎn)方式進(jìn)行研究。第一部分介紹采礦權(quán)流轉(zhuǎn)的基礎(chǔ)理論；第二部分分析了我國(guó)采礦權(quán)流轉(zhuǎn)方式的規(guī)范現(xiàn)狀,從采礦權(quán)流轉(zhuǎn)監(jiān)管現(xiàn)狀和采礦權(quán)轉(zhuǎn)讓合同規(guī)范現(xiàn)狀兩個(gè)方面進(jìn)行；第三部分首先闡述了我國(guó)采礦權(quán)流轉(zhuǎn)存在的問題,包括采礦權(quán)非法轉(zhuǎn)讓、采礦權(quán)抵押管理混亂、受讓人資質(zhì)原則化、礦業(yè)權(quán)交易機(jī)構(gòu)不規(guī)范及采礦權(quán)審批機(jī)關(guān)職責(zé)不統(tǒng)一五個(gè)方面,然后對(duì)存在這些問題的原因進(jìn)行分析；第四部分是完善我國(guó)采礦權(quán)流轉(zhuǎn)方式的建議,包括完善立法、明確受讓人資質(zhì)、規(guī)范礦業(yè)權(quán)交易市場(chǎng)、嚴(yán)格采礦權(quán)轉(zhuǎn)讓審批以及加強(qiáng)政府監(jiān)管五個(gè)方面。
[Abstract]:Mineral resources play an important role in the social and economic development of our country, and the limitation of mineral resources and the infinity of human needs require the rational allocation of mineral resources. The system of mining right circulation is realized through mining right circulation mode, so the perfection of mining right circulation mode is of great significance to the construction of mining right circulation market in our country. Due to the immature system of mining rights circulation, the circulation of mining rights in practice has produced such problems as widespread illegal transfer, frequent safety accidents and serious environmental damage, etc., which requires the strengthening of the supervision of mining rights circulation. This paper is divided into four parts to study the transfer of mining rights. The first part introduces the basic theory of the transfer of mining rights. The third part expounds the problems existing in the transfer of mining rights in China, including illegal transfer of mining rights, mining rights mortgage management confusion, The transferee qualification is principled, the mining right trading organization is not standardized, and the mining right examination and approval authority is not unified in five aspects, then the reasons for these problems are analyzed. Part 4th is the suggestion to perfect the mode of mining right circulation in our country. It includes perfecting legislation, clarifying the qualification of transferee, standardizing the trading market of mining rights, strictly approving the transfer of mining rights and strengthening government supervision.
