【摘要】：“能源”一詞自誕生以來(lái),便已影響人們的生活,關(guān)系國(guó)家的存亡與發(fā)展。特別是人類社會(huì)開(kāi)啟工業(yè)革命后,對(duì)能源的需求更是與日俱增,可以這樣說(shuō),如果沒(méi)有能源或是能源供應(yīng)中斷,人類社會(huì)便會(huì)陷入混亂,直至滅亡。在人類當(dāng)下能源利用結(jié)構(gòu)中,盡管可再生能源、清潔能源等能源所占比重正逐步提高,但是化石能源幾乎不可代替,特別是石油,維持著地球上人類生活、經(jīng)濟(jì)發(fā)展與社會(huì)進(jìn)步,重要性不言而喻。然而,在地球上,能源儲(chǔ)量畢竟有限,且能源分布不均,受國(guó)內(nèi)國(guó)際局勢(shì)影響,能源安全問(wèn)題便時(shí)常影響國(guó)家的穩(wěn)定和發(fā)展。能源安全關(guān)系國(guó)計(jì)民生,是國(guó)家法律政策的重中之重。然而,我國(guó)能源安全法律制度極不完善,能源法律體系尚未建立,能源法律制度不完整,不能有效的保障我國(guó)的能源安全。因此,本文從能源安全概念及其相關(guān)問(wèn)題研究入手,分析我國(guó)能源安全法律制度的現(xiàn)狀,再通過(guò)借鑒國(guó)外主要發(fā)達(dá)國(guó)家的能源安全立法經(jīng)驗(yàn),探討建立健全能源安全法律體系,完善能源安全法律制度。文章分為五個(gè)部分,第一部分,論述能源安全及其相關(guān)問(wèn)題,旨在闡述保障能源安全的必要性；第二部分,論述我國(guó)能源安全法律制度的現(xiàn)狀；第三部分,論述我國(guó)能源安全法律制度的缺陷；第四部分,闡述主要發(fā)達(dá)國(guó)家能源安全能源安全法律制度及其對(duì)我國(guó)的啟示；第五部分,論述如何完善我國(guó)能源安全法律制度。
[Abstract]:Since its birth, the term "energy" has affected people's lives and has a bearing on the survival and development of our country. In particular, since the industrial revolution began in human society, the demand for energy has increased. If there is no energy or if the energy supply is interrupted, the human society will fall into chaos until its demise. In the current energy use structure of mankind, although the share of renewable energy, clean energy and other energy sources is gradually increasing, But fossil energy is almost irreplaceable, especially oil, which sustains human life, economic development and social progress on the planet. However, on Earth, energy reserves are limited and energy distribution is uneven. Under the influence of the domestic and international situation, energy security issues often affect the stability and development of the country. Energy security relates to the national economy and the people's livelihood, which is the top priority of the national legal policy. However, the legal system of energy security in our country is extremely imperfect. The legal system of energy has not yet been established, and the legal system of energy is incomplete, which can not effectively guarantee the energy security of our country. Therefore, this paper begins with the research of the concept of energy security and its related problems, and analyzes the present situation of the legal system of energy security in China. Then, by drawing lessons from the experience of the major developed countries in foreign countries on energy security legislation, this paper discusses the establishment of a sound legal system for energy security and the perfection of the legal system of energy security. The article is divided into five parts. The first part discusses energy security and its related problems. The second part discusses the current situation of our country's energy security legal system; the third part, discusses the defects of our country's energy security legal system; the 4th part, This paper expounds the legal system of energy security in major developed countries and its enlightenment to China. Part 5th discusses how to perfect the legal system of energy security in China.
