【摘要】： 在社會(huì)不斷進(jìn)步的同時(shí),環(huán)境問題也頻頻出現(xiàn)在了人們的視野里,由于環(huán)境污染而患病甚至死亡的人數(shù)也在不斷增加。但不幸的是,因果關(guān)系錯(cuò)綜復(fù)雜,在認(rèn)定過程中,人們往往因?yàn)橐蚬P(guān)系難以認(rèn)定,致使許多受害者無法運(yùn)用法律手段維護(hù)自己的合法權(quán)益。蓋然性學(xué)說、實(shí)事推定說、疫學(xué)因果關(guān)系說、T細(xì)胞研究說等分別從降低證明程度、運(yùn)用科學(xué)技術(shù)等方式,為人們認(rèn)定因果關(guān)系開拓了道路。在二戰(zhàn)剛剛結(jié)束的幾年,人們更關(guān)注的是經(jīng)濟(jì)的發(fā)展,而非環(huán)境對(duì)人體的影響。相應(yīng)的,認(rèn)定環(huán)境侵權(quán)中因果關(guān)系的方式也比較傳統(tǒng)。但是,隨著經(jīng)濟(jì)的發(fā)展,環(huán)境問題也越來越嚴(yán)重。從日本的四大公害事件到印度的博帕爾慘案,人類經(jīng)歷了太多的痛苦。如何補(bǔ)救受害人的損失,認(rèn)定污染者與損害之間存在因果關(guān)系也日益重要起來。認(rèn)定因果關(guān)系的理論也逐漸豐富。例如,蓋然性學(xué)說運(yùn)用優(yōu)勢(shì)證據(jù)或事實(shí)推定理論,可以使受害者更容易的解決因果關(guān)系問題。同時(shí),疫學(xué)因果說等進(jìn)一步補(bǔ)充了上述理論。在美國,針對(duì)毒物侵害,學(xué)者們也相繼提出了一些新的理論。如1事實(shí)表明原則,2證據(jù)優(yōu)越性說,3流行病研究理論,4特別證據(jù)理論,5 T細(xì)胞研究理論,6比例規(guī)則說。各種學(xué)說都有利于我們解決因果關(guān)系困境,及時(shí)維護(hù)受害人的合法利益。為我們司法實(shí)踐帶來了依據(jù),值得我們學(xué)習(xí)采納。
[Abstract]:As society progresses, environmental problems appear frequently in people's eyes, and the number of people suffering from or even dying from environmental pollution is increasing. Unfortunately, the causal relationship is so complicated that in the process of identification, People often find it difficult to identify causality, resulting in many victims unable to use legal means to safeguard their legitimate rights and interests. The theory of inevitability, the theory of factual presumption, the theory of epidemic causality, the theory of T cell research, and so on, respectively, reduce the level of proof. The use of science and technology has opened the way for people to identify causality. In the few years since the end of World War II, people were more concerned about economic development than the impact of the environment on the human body. The way to determine causality in environmental tort is also more traditional. However, with the development of the economy, environmental problems are becoming more and more serious. From the four major pollution incidents in Japan to the Bhopal tragedy in India, Human beings have gone through too much pain. It is also increasingly important to find a causal link between the polluter and the damage, and how to remedy the victim's loss. The theory of causal relationship is also becoming more and more abundant. For example, The theory of inevitability can make it easier for victims to solve the problem of causality by using evidence of superiority or theory of presumption of fact. At the same time, the theory is further supplemented by the theory of epidemic causality. Scholars have also put forward some new theories one after another. For example, the facts show the principle and the superiority of evidence. The theory of special evidence, the theory of special evidence, the theory of T cell research and the theory of proportion rule. All kinds of theories are in favor of us. They solve the problem of causation, Protecting the legitimate interests of the victims in time brings the basis for our judicial practice and is worthy of our study and adoption.
