【摘要】： 冰雪資源是一種季節(jié)性自然資源,隨著現(xiàn)代社會的不斷發(fā)展和經(jīng)濟(jì)文化的日新月異,近年來,冰雪資源逐漸被更為廣義地附加了一層社會資源的外延。政府通過做大做強(qiáng)冰雪產(chǎn)業(yè),豐富弘揚(yáng)冰雪文化,實(shí)現(xiàn)一定的經(jīng)濟(jì)效益與文化效應(yīng)。但在政府對冰雪資源的開發(fā)利用過程中,還存在諸如政府管理不細(xì)致不到位導(dǎo)致的冰雪經(jīng)濟(jì)一片“賠錢吆喝”之聲；市場結(jié)構(gòu)單一,經(jīng)營理念落后；公眾參與熱情低等問題。而08年突如其來的低溫雪災(zāi),南方十省應(yīng)對災(zāi)情的措手不及,人身財(cái)產(chǎn)的嚴(yán)重?fù)p失,都為我們敲響警鐘：讓我們意識到冰雪資源并不是只有產(chǎn)業(yè)化的開發(fā)利用,冰雪災(zāi)害的防治也已不再只是北方地區(qū)的專有,冰雪災(zāi)害防治也必須要上升到全國全局齊抓共管的高度。 所以,我國政府必須要重視冰雪資源的管理。文章首先從界定冰雪資源管理的概念、了解冰雪資源管理的特性入手,對冰雪資源管理的發(fā)展歷史沿革進(jìn)行深入解讀,為準(zhǔn)確提出冰雪資源管理的法律對策與建議奠定堅(jiān)實(shí)的理論基礎(chǔ)。其次,通過對比國內(nèi)外現(xiàn)行冰雪資源管理現(xiàn)狀,分析得出我國冰雪資源管理中在立法方面存在現(xiàn)行法律法規(guī)層級低、缺少統(tǒng)一管理的防災(zāi)減災(zāi)類法律等問題；在機(jī)制方面存在政府相關(guān)職能與機(jī)制不完善、執(zhí)法主體效率低下、政府間因體制不順導(dǎo)致溝通合作意識欠缺等問題；同時還存在一系列諸如市場引導(dǎo)、信息公開、公眾參與、財(cái)政投入等制度方面的問題與不足。國外冰雪資源管理的優(yōu)秀經(jīng)驗(yàn)與辦法,值得我們認(rèn)真的學(xué)習(xí)與借鑒。文章立足可持續(xù)發(fā)展思想基礎(chǔ)之上,針對現(xiàn)狀與不足,從法律角度提出如下建議與對策：在依法管理的前提下立法規(guī)范冰雪產(chǎn)業(yè)發(fā)展,修改完善現(xiàn)行法律,加快制定《防災(zāi)減災(zāi)基本法》；充實(shí)完善包括災(zāi)前預(yù)警、災(zāi)中應(yīng)急聯(lián)動、災(zāi)后救濟(jì)重建在內(nèi)的冰雪災(zāi)害應(yīng)急機(jī)制；同時注意加強(qiáng)社會公眾參與、行政問責(zé)、財(cái)政投入等制度建設(shè),保障冰雪資源管理的良好運(yùn)行,、最終使冰雪資源管理實(shí)現(xiàn)經(jīng)濟(jì)效益與社會效應(yīng)的雙贏。
[Abstract]:Ice and snow resources are seasonal natural resources. With the continuous development of modern society and the rapid development of economy and culture, in recent years, Ice and snow resources have gradually been added to a broader extension of social resources. The government enriches ice and snow culture by making ice and snow industries bigger and stronger. But in the course of the government's exploitation and utilization of ice and snow resources, there is still a sound of "losing money" in the ice and snow economy caused by the lack of careful government management, and the market structure is single. Business philosophy is backward, public participation enthusiasm is low, and so on. But in 2008, the sudden low temperature snow disaster, the ten southern provinces were unprepared to deal with the disaster, and the serious loss of life and property, It is a wake-up call for us to realize that ice and snow resources are not only developed and utilized in an industrial way, and that the prevention and treatment of snow and ice disasters are no longer the exclusive preserve of the northern region. Ice and snow disaster prevention and control must also rise to the national overall level of joint management. Therefore, the government of our country must attach importance to the management of ice and snow resources. Firstly, this article begins with defining the concept of ice and snow resources management and understanding the characteristics of ice and snow resources management, and deeply interprets the history and evolution of ice and snow resources management. In order to accurately put forward the legal countermeasures and suggestions of ice and snow resources management to lay a solid theoretical foundation. Secondly, by comparing the current situation of ice and snow resources management at home and abroad, It is concluded that there are some problems in the legislation of ice and snow resources management in our country, such as the low level of current laws and regulations, the lack of unified management of disaster prevention and mitigation laws, the imperfect functions and mechanisms of the government and the inefficiency of the subject of law enforcement in the aspect of mechanism. At the same time, there are a series of problems such as market guidance, information disclosure, public participation, etc. Financial investment and other institutional problems and deficiencies. Foreign ice and snow resources management of excellent experience and methods, worthy of our careful study and reference. Based on the idea of sustainable development, the article aims at the current situation and deficiencies, From the legal point of view, the following suggestions and countermeasures are put forward: legislating to standardize the development of ice and snow industry under the premise of managing according to law, revising and perfecting the existing laws, speeding up the formulation of the basic Law for disaster Prevention and Mitigation, enriching and perfecting the measures including pre-disaster early warning, emergency response in disaster, Emergency mechanisms for ice and snow disasters, including disaster relief and reconstruction; at the same time, attention should be paid to strengthening the system of public participation, administrative accountability and financial input. To ensure the good operation of ice and snow resources management, to make the ice and snow resources management realize the win-win of economic benefit and social effect.
