【摘要】：日本福島核泄漏事故造成了嚴重損失,影響也極其廣泛。反思日本20世紀50年代以來逐步建立的核電安全法律控制體系,其存在著諸多結構性問題,包括階段性管制方式效果不佳、檢查制度種類過多且重復、難以開展機動性檢查、管制手法落后等。進一步審視日本20世紀70年代建立的雙重監(jiān)督體制,其存在的必要性正在喪失,效率性受到質疑,獨立性遭到批判,并未發(fā)揮真正的監(jiān)管作用,雙重監(jiān)督體制需進行改革。日本核電企業(yè)隱瞞事故、篡改數(shù)據(jù),不履行信息公開義務,在積極守法和構建核安全文化上止步不前。這些都為中國提供了不少啟示。
[Abstract]:The Fukushima nuclear accident in Japan has caused serious losses, and the impact has been extremely extensive. Reflecting on the nuclear power safety legal control system gradually established in Japan since 1950s, there are many structural problems. Including the poor effect of the phased control methods, the excessive and repeated types of inspection systems, the difficulty of carrying out mobile inspections, the backward control techniques, etc. Further examine the dual supervision system established in Japan in 1970s. The necessity of its existence is being lost, its efficiency has been questioned, its independence has been criticized, it has not played a real regulatory role, and the dual supervision system needs to be reformed. Japanese nuclear power companies conceal accidents and tamper with data. Failure to fulfill information disclosure obligations, to actively abide by the law and to build a nuclear safety culture, all of which provide a lot of enlightenment for China.
