【摘要】：土壤污染修復(fù)作為維持、保障土壤本身性質(zhì)與功能的主要手段,對于食品安全與社會公眾的健康,具有極其重要的意義。由于土壤污染修復(fù)對技術(shù)、資金等要素的要求較高,因而,土壤污染修復(fù)資金的保障,對于土壤污染修復(fù)技術(shù)的研發(fā)與應(yīng)用以及土壤污染修復(fù)質(zhì)量的提升,具有重要的現(xiàn)實意義。然而,現(xiàn)階段我國關(guān)于土壤污染修復(fù)資金的來源,主要依靠政府財政支持,缺少吸引社會資本投入土壤污染修復(fù)的平臺。加之,由于土壤污染修復(fù)資金管理專門性規(guī)范的缺失,使其管理運行不暢,具體表現(xiàn)在:資金使用審批程序繁瑣,不能滿足土壤修復(fù)工作緊迫性的需要。相較而言,國外對于土壤修復(fù)資金的管理已較為成熟,表現(xiàn)在:來源渠道廣泛,有明確專門性的法律依據(jù),管理模式較為先進(jìn)等方面。這對于我國土壤污染修復(fù)基金管理規(guī)范的制定及其運行,具有很強的借鑒意義。基于此,筆者結(jié)合我國現(xiàn)階段土壤污染修復(fù)立法與實踐現(xiàn)狀,分別從基金繳存、基金管理及基金運行管理的監(jiān)督等方面,進(jìn)行了初步的探討。本文主體部分分為五個部分。第一部分介紹了選題背景和國內(nèi)外研究現(xiàn)狀。第二部分對土壤污染修復(fù)基金進(jìn)行了概述。一方面明確了土壤污染修復(fù)的一些基本問題,對其概念、現(xiàn)狀及存在的問題予以闡述;另一方面介紹了土壤污染修復(fù)基金的概念,并提出了土壤污染修復(fù)基金法律化問題。第三部分闡述了我國土壤污染修復(fù)基金立法的必要性及可行性。第四部分介紹了美國、荷蘭及我國臺灣地區(qū)有關(guān)土壤污染修復(fù)基金的法律制度。并在此基礎(chǔ)上,結(jié)合我國土壤污染修復(fù)的現(xiàn)狀及問題,梳理出了建立健全我國土壤污染修復(fù)基金制度的有益經(jīng)驗。第五部分對構(gòu)建我國土壤污染修復(fù)基金法律制度提出如下建議:基金繳存制度的建立,規(guī)定了資金的法定來源渠道;基金運作模式的優(yōu)化,規(guī)定了基金申請主體及基金適用條件與范圍,同時對基金運作及管理模式的優(yōu)化,有利于保障土壤污染修復(fù)資金的穩(wěn)定性;關(guān)于基金審批、使用的監(jiān)管,規(guī)定了基金審批與使用的監(jiān)管主體與監(jiān)管內(nèi)容以及違反基金管理規(guī)范所承擔(dān)的法律責(zé)任。通過上述土壤污染修復(fù)基金制度的構(gòu)建,來保障被污染土壤的修復(fù)。
[Abstract]:Soil pollution remediation, as the main means to maintain and protect the nature and function of soil, is of great significance for food safety and public health, because soil pollution remediation is of great importance to the technology. Therefore, the guarantee of funds for soil pollution remediation is of great practical significance for the development and application of soil pollution remediation technology and the improvement of soil pollution remediation quality. At this stage, the sources of funds for soil pollution remediation in China mainly rely on the financial support of the government, and lack of the platform to attract social capital to soil pollution remediation. Because of the lack of special regulation of fund management for soil pollution remediation, the operation of management is not smooth. The concrete performance is that the procedures for approving the use of funds are cumbersome, which can not meet the urgent needs of soil remediation work. The management of soil remediation funds in foreign countries has been more mature, manifested in: a wide range of sources, there is a specific legal basis. The management model is more advanced, which has a strong reference significance for the establishment and operation of soil pollution remediation fund management standard in China. Combined with the present situation of legislation and practice of soil pollution remediation in our country, the author respectively from the fund deposit, fund management and fund operation management supervision and so on. The main part of this paper is divided into five parts. The first part introduces the background of selecting the topic and the current research situation at home and abroad. The second part summarizes the fund for soil pollution remediation. On the one hand, it clarifies the soil pollution. Some basic problems in dyeing and repairing. The concept, the present situation and the existing problems are expounded. On the other hand, the concept of soil pollution remediation fund is introduced. The third part expounds the necessity and feasibility of legislation of soil pollution remediation fund in China. Part 4th introduces the United States. The legal system of soil pollution remediation fund in the Netherlands and Taiwan. On this basis, the present situation and problems of soil pollution remediation in China are discussed. Combing out the beneficial experience of establishing and perfecting the fund system of soil pollution remediation in China. Part 5th puts forward the following suggestions to construct the legal system of soil pollution remediation fund of our country: the establishment of fund deposit system. The legal sources of funds are provided; The optimization of the fund operation mode stipulates the main body of the fund application and the application condition and scope of the fund, and at the same time, optimizes the fund operation and management mode, which is helpful to ensure the stability of the fund for soil pollution remediation. About the fund examination and approval, the use supervision, has stipulated the fund examination and approval and the use supervision main body and the supervision content as well as violates the fund management standard to undertake the legal responsibility, through above soil pollution remediation fund system construction. To protect the remediation of contaminated soil.
