【摘要】：隨著人類社會(huì)的不斷發(fā)展,環(huán)境質(zhì)量空前惡化,污染事故迭出不窮,人們的生存受到前所未有的挑戰(zhàn),環(huán)境問(wèn)題越來(lái)越突出地?cái)[在世人面前,逐漸成為人類關(guān)注的焦點(diǎn)。世界許多國(guó)家都在進(jìn)一步完善環(huán)境保護(hù)法律制度,但我國(guó)的環(huán)境保護(hù)卻依然薄弱而滯后,然而公民的權(quán)利保障意識(shí)卻不斷加強(qiáng),因此面對(duì)二者之間凸顯的矛盾,要求我國(guó)必須正視環(huán)境,保障權(quán)利,適應(yīng)和諧社會(huì)的要求。 本文運(yùn)用文獻(xiàn)研究和描述性研究的方法,通過(guò)提出問(wèn)題,分析問(wèn)題和解決問(wèn)題的發(fā)展思路,對(duì)環(huán)境問(wèn)題的產(chǎn)生以及環(huán)境保護(hù)與權(quán)利保障之關(guān)系進(jìn)行認(rèn)真的闡述,進(jìn)而指出我國(guó)目前環(huán)境保護(hù)所面臨的危機(jī)和不足,最終提出了完善我國(guó)環(huán)境保護(hù)與權(quán)利保障之關(guān)系的一些簡(jiǎn)單構(gòu)想,尤其是關(guān)于對(duì)公民的環(huán)境權(quán)進(jìn)行富有創(chuàng)造性的探析和闡述,在當(dāng)下中國(guó)的法治建設(shè)與發(fā)展中具有非同一般的意義。
[Abstract]:With the continuous development of human society, the environmental quality is deteriorating unprecedented, pollution accidents occur one after another, people's survival has been unprecedented challenges, environmental problems are more and more prominent in front of the world. Gradually become the focus of human attention. Many countries in the world are further improving the legal system of environmental protection, but China's environmental protection is still weak and lagging behind, but citizens' awareness of the protection of rights has been strengthened. Therefore, in the face of the contradiction between the two, we must face up to the environment, protect rights and adapt to the requirements of a harmonious society. This paper uses the methods of literature research and descriptive research, through raising problems, analyzing problems and solving problems of the development ideas. The emergence of environmental problems and the relationship between environmental protection and the protection of rights are carefully elaborated, and then the crisis and shortcomings of environmental protection in China are pointed out. Finally, the author puts forward some simple ideas to improve the relationship between environmental protection and rights protection, especially on the creative analysis and elaboration of citizens' environmental rights. It is of great significance in the construction and development of the rule of law in China.
