【摘要】：近些年我國的經(jīng)濟(jì)保持高速增長，環(huán)境污染主體的經(jīng)濟(jì)實(shí)力也在這一過程中得到快速提升，但是其排污量以及應(yīng)對(duì)環(huán)境經(jīng)濟(jì)處罰的能力也隨之提高。環(huán)境法律法規(guī)在此所表現(xiàn)出的問題更加凸顯，尤其是環(huán)境行政處罰。環(huán)境違法者受經(jīng)濟(jì)利益的驅(qū)使，排污行為是不間斷的或者是反復(fù)進(jìn)行的，即排污行為的持續(xù)性特點(diǎn)明顯，環(huán)境行政處罰對(duì)此卻缺乏針對(duì)性的對(duì)策。“按日計(jì)罰”是解決此問題的重要思路，其針對(duì)實(shí)踐中環(huán)境違法行為普遍存在的“繼續(xù)性或連續(xù)性”特征，以日為單位進(jìn)行處罰，徹底實(shí)現(xiàn)對(duì)排污者的動(dòng)態(tài)監(jiān)管。 文章在學(xué)者們對(duì)按日計(jì)罰制度的正當(dāng)性與可行性研究的基礎(chǔ)上，首先對(duì)按日計(jì)罰制度的基本問題進(jìn)行了系統(tǒng)的闡述，明確解釋了何為環(huán)境行政違法行為的繼續(xù)性與連續(xù)性特征，認(rèn)為按日計(jì)罰制度應(yīng)定位于環(huán)境行政罰款的計(jì)罰方式之一，，在此基礎(chǔ)上，闡明“按日計(jì)罰”制度與“一事不再罰原則”并不沖突。我國目前環(huán)境行政罰款存在諸多問題，比如，罰款的設(shè)置方式不合理，罰款數(shù)額設(shè)置的靜態(tài)特征明顯，與社會(huì)發(fā)展不相適應(yīng)等。按日計(jì)罰制度是以環(huán)境行政罰款存在的問題為出發(fā)點(diǎn)的，同時(shí)完善環(huán)境行政罰款制度也應(yīng)在按日計(jì)罰制度的框架內(nèi)進(jìn)行。我國的重慶市與深圳市的地方環(huán)保條例，已經(jīng)對(duì)“按日計(jì)罰”進(jìn)行了積極的探索，雖然與本文希冀構(gòu)建的按日計(jì)罰制度存在差別，但是借此素材，文章對(duì)按日計(jì)罰制度的適用范圍與計(jì)算起止日，罰款的設(shè)置方式與每日處罰額度的設(shè)置，按日計(jì)罰制度與現(xiàn)有環(huán)境法律法規(guī)的銜接等問題提出了一些解決的思路。
[Abstract]:In recent years, the economy of our country has maintained rapid growth, and the economic strength of the main body of environmental pollution has also been promoted rapidly in this process. However, the amount of pollution and the ability to deal with environmental and economic penalties are also improved. Environmental laws and regulations in this more prominent problems, especially environmental administrative penalties. Environmental violators are driven by economic interests. The pollution behavior is uninterrupted or repeated, that is, the persistent characteristic of the discharge behavior is obvious, but the environmental administrative punishment is lack of targeted countermeasures. "Daily punishment" is an important way to solve this problem. In view of the "continuance or continuity" characteristic of environmental illegal behavior in practice, it carries on the punishment with the day as the unit, realizes thoroughly the dynamic supervision to the polluter. On the basis of the scholars' research on the legitimacy and feasibility of the daily penalty system, this paper first systematically expounds the basic problems of the daily planning and punishment system. This paper explains clearly what is the continuous and continuous characteristics of environmental administrative illegal acts, and points out that the daily calculating and punishing system should be one of the ways of calculating and punishing environmental administrative fines, and on this basis. There are many problems in environmental administrative penalty in our country. For example, the way of setting fines is unreasonable, and the static characteristics of the setting of fines amount are obvious. The daily penalty system is based on the problem of environmental administrative penalty. At the same time, the improvement of environmental administrative penalty system should also be carried out within the framework of the daily penalty system. The local environmental regulations of Chongqing and Shenzhen have made an active exploration of "daily penalty". Although there is a difference between the daily penalty system and the expected daily penalty system, the paper takes this material as the basis for the application of the daily penalty system and the calculation of the starting and ending day, the setting method of the fine and the setting of the daily penalty quota. This paper puts forward some solutions to the problems such as the connection between the system of daily calculation and punishment and the existing environmental laws and regulations.
