【摘要】：環(huán)境法執(zhí)行難是發(fā)展中國家共同的難題,巴西作為一個(gè)發(fā)展中大國也不例外。雖然巴西環(huán)境立法相對(duì)于其他發(fā)展中國家而言較為完善,但由于環(huán)境行政執(zhí)法機(jī)構(gòu)的執(zhí)法能力和意愿均不足,使得巴西環(huán)境法執(zhí)行狀況長期較差。為了解決這一難題,巴西于20世紀(jì)80年代末修改了憲法,在憲法中明確規(guī)定了公民的環(huán)境權(quán),特別是通過強(qiáng)化檢察機(jī)關(guān)的地位和權(quán)力,并使其成為環(huán)境公共利益的代言人的方式,推動(dòng)環(huán)境法的執(zhí)行。本文意在探索巴西檢察機(jī)構(gòu)通過司法活動(dòng)介入環(huán)境法執(zhí)行的原因、路徑、成效及不足,并從中總結(jié)了一些對(duì)我國有益的啟示。
[Abstract]:Enforcement of environmental law is a common problem for developing countries, and Brazil is no exception as a large developing country, although its environmental legislation is relatively perfect compared with other developing countries. However, due to the lack of enforcement capacity and willingness of environmental administrative law enforcement agencies, the implementation of environmental law in Brazil has been poor for a long time. In order to solve this problem, Brazil amended its Constitution at the end of 1980s. The environmental rights of citizens are clearly stipulated in the Constitution, especially by strengthening the position and power of the procuratorial organs and making them the spokesmen of the environmental public interests. The purpose of this paper is to explore the causes, paths, effects and deficiencies of the Brazilian procuratorial institutions' intervention in the enforcement of environmental law through judicial activities, and to sum up some useful revelations for our country.
