        本文首先闡明了經(jīng)濟(jì)全球化時(shí)代國(guó)家利益發(fā)生的新變化，指出了全球化時(shí)代國(guó)家利益國(guó)際拓展趨勢(shì)加強(qiáng)，直接推動(dòng)了國(guó)家海外利益的發(fā)展。對(duì)海外利益的拓展和保護(hù)，實(shí)現(xiàn)國(guó)家利益的發(fā)展和完善，已經(jīng)成為各國(guó)對(duì)外戰(zhàn)略的重要組成部分。隨著中國(guó)改革開(kāi)放和“走出去”戰(zhàn)略的實(shí)施，中國(guó)與外部世界交往與聯(lián)系更加緊密和深入，國(guó)家利益不斷向境外延伸，中國(guó)海外利益在此過(guò)程中凸顯并不斷拓展。通過(guò)梳理中國(guó)海外利益的發(fā)展現(xiàn)狀，發(fā)現(xiàn)受多重因素的影響，中國(guó)海外利益呈現(xiàn)出范圍動(dòng)態(tài)性，形式多樣性，危險(xiǎn)多源性以及保護(hù)方式復(fù)雜性等特征。同時(shí)通過(guò)對(duì)國(guó)際法在國(guó)際關(guān)系中的價(jià)值研究，特別是從秩序和利益兩個(gè)維度對(duì)國(guó)際法進(jìn)行分析，得出以國(guó)際法為依據(jù)對(duì)中國(guó)海外利益開(kāi)展保護(hù)，這樣既能減少摩擦又能增加共識(shí)，從而達(dá)到合理合法保護(hù)中國(guó)海外利益的目的。從海外利益所屬的利益主體劃分，本文進(jìn)一步分析了當(dāng)前中國(guó)海外國(guó)家利益、海外法人利益以及海外公民利益各所面臨的安全風(fēng)險(xiǎn)，并在此基礎(chǔ)上以國(guó)際法相關(guān)規(guī)則為依據(jù)探討針對(duì)這三種屬性不同的中國(guó)海外利益保護(hù)問(wèn)題。

    This paper will give a general idea of national interests in the era of globaleconomy which has changed rapidly as well as been strengthened in the internationalextension. And the national overseas interests were definitely improved according tothese new changes. It has become a critical part of foreign strategies of every nation inthe world to extend and protect the overseas interests for the pursuit of completingtheir national interest.China has built a closer contact with the outside world through the China’sreform and opening-up policy as well as the go out policy. Meanwhile China’snational interests have been extended outside during this process. Many factors playan influential role in the complicated conditions such as diversified modes andflexible protective mechanism. The method of reducing conflicts as well as increasingcommon sense regarding China’s overseas interest protection is to be based on theinternational law which especially focused on the order and interests. This paper willdiscuss three different properties of China’s overseas interests following by theanalysis of the safety risks which lie in China’s national overseas interests, overseascooperate interests and overseas citizens’ interests as well.
