【摘要】：中國(guó)大陸與澳門特區(qū)的法律體系盡管同屬大陸法系 ,但由于歷史的原因 ,兩地又為不同的法域 ,因而兩地的公司法從形式到內(nèi)容仍存在很大差異。隨著澳門回歸祖國(guó) ,中國(guó)大陸與澳門特區(qū)的經(jīng)濟(jì)、文化等方面的交流更為活躍和頻繁 ,因而探討兩地間有關(guān)公司法律制度的異同及其成因 ,并提出相應(yīng)的對(duì)策和建議 ,有利于克服兩地間因公司法不同而形成的障礙 ,對(duì)兩地間加強(qiáng)經(jīng)貿(mào)聯(lián)系和法律交流有著極為突出的緊迫性和現(xiàn)實(shí)意義
[Abstract]:Although the legal systems of mainland China and Macao Special Administrative region belong to the same civil law system, due to historical reasons, the two places are different jurisdictions, so there are still great differences in the form and content of the company law between the two places. With the return of Macao to the motherland, the economic and cultural exchanges between the mainland of China and the Macao Special Administrative region have become more active and frequent. Therefore, the similarities and differences between the relevant corporate legal systems between the two places and their causes are discussed, and the corresponding countermeasures and suggestions are put forward. It is beneficial to overcome the obstacles caused by the difference of company law between the two places, and it is of great urgency and practical significance to strengthen the economic and trade links and legal exchanges between the two places.
