【摘要】:職務發(fā)明獎酬對于合理分配單位與發(fā)明人的利益具有重要作用;诼殑瞻l(fā)明獎酬的特殊屬性,有必要借鑒公司法中股東抽象紅利分配請求權規(guī)則,在發(fā)明人與單位就獎酬事項約定不明或沒有約定時賦予其抽象職務發(fā)明獎酬請求權。以此能夠有效克服職務發(fā)明獎酬支付主體不固定、數(shù)額標準不明確、舉證責任分配不公平和訴訟時效認定標準不統(tǒng)一等司法困境,實現(xiàn)職務發(fā)明經濟利益的分配正義,保護發(fā)明人的獎酬權益,激發(fā)創(chuàng)新熱情。
[Abstract]:The reward of job inventor plays an important role in the rational distribution of the interests of the unit and the inventor. Based on the special attribute of the reward for the job inventor, it is necessary to draw lessons from the rules of the shareholders' right of claim for the distribution of abstract dividend in the Company Law, and give the inventor and the unit the right to claim the reward for the abstract job when the agreement on the matter of reward and remuneration is unclear or not. In this way, we can effectively overcome the judicial difficulties, such as the uncertainty of the subject of payment, the unclear standard of the amount, the unfair distribution of the burden of proof and the inconsistency of the standard of limitation of action, so as to realize the distribution justice of the economic benefits of the job invention. Protect the rights and interests of inventors, stimulate innovation enthusiasm.
