【摘要】：知情權(quán)是現(xiàn)代公民的基本權(quán)利,又稱為知的權(quán)利、知悉權(quán)、資訊權(quán)、信息權(quán)或了解權(quán)。隨著人民主權(quán)的理念的深入,作為政治民主化的一種必然要求和結(jié)果,知情權(quán)首先出現(xiàn)在公法領(lǐng)域�，F(xiàn)今,由于知情權(quán)是一項獨立權(quán)利,在隨著社會的進(jìn)步與發(fā)展,知情權(quán)也在演變,其外延已不斷擴(kuò)大,在私法領(lǐng)域中也出現(xiàn),即已經(jīng)擴(kuò)展至私法領(lǐng)域。 自20世紀(jì)90年代開始,我國學(xué)者對知情權(quán)進(jìn)入了深入地研究。本文主要從個方面討論了知情權(quán)。首先是知情權(quán)的概述,介紹了知情權(quán)的概念、存在形式、組成、屬性和法律特征。其次,介紹了我國知情權(quán)的保護(hù)成就和存在的問題。最后,提出了保障知情權(quán)的建議,如轉(zhuǎn)變觀念,要提高公民的文化素質(zhì),增強(qiáng)公民對知情權(quán)重要性的認(rèn)識,提高政府的人民主權(quán)憲政理念；將知情權(quán)明確寫入憲法,是世界各國的潮流發(fā)展,這樣才可以根本上確立知情權(quán)的重要地位；制定《政府信息公開法》代替《政府信息公開條例》,我國已經(jīng)頒布了《政府信息公開條例》,但是這部條例由國務(wù)院制定的,還沒上升到法律的層面,其位階效力比較低,不利于保障公民的知情權(quán)；完善知情權(quán)的法律保障制度,既要建立健全知情權(quán)的保障制度,要建立建立健全行政問責(zé)制度、行政救濟(jì)制度、完善知情權(quán)的賠償制度等知情權(quán)的救濟(jì)制度。
[Abstract]:The right to know is the basic right of modern citizens, also known as the right to know, the right to know, the right to information, the right to information or the right to understand. With the deepening of the concept of people's sovereignty, as a necessary requirement and result of political democratization. The right to know first appears in the field of public law. Nowadays, due to the right to know is an independent right, with the progress and development of society, the right to know is also evolving, its extension has been expanding, and also in the field of private law. That is, it has been extended to the field of private law. Since 1990s, Chinese scholars have entered a deep study of the right to know. This paper mainly discusses the right to know from the following aspects. First, the overview of the right to know, introduces the concept of the right to know, the form of existence. Composition, attributes and legal characteristics. Secondly, the protection of the right to know in China and the existing problems. Finally, put forward some suggestions to protect the right to know, such as changing ideas, to improve the cultural quality of citizens. Enhance citizens' understanding of the importance of the right to know and enhance the government's concept of people's sovereign constitutionalism; It is the trend of the world to write the right to know into the constitution, so that the important position of the right to know can be established. Government Information publicity Act has been enacted in place of the Government Information Disclosure regulations. However, the regulations formulated by the State Council have not yet risen to the level of the law. The effectiveness of its rank is relatively low, which is not conducive to the protection of citizens' right to know; To perfect the legal guarantee system of the right to know, we should establish and perfect the system of the guarantee of the right to know, the system of administrative accountability system, the system of administrative relief, the system of compensation of the right to know, and the relief system of the right to know.
