【摘要】：檢律關(guān)系并非慣常所述的只有案件承辦人和辯護(hù)律師之間的單一對(duì)抗關(guān)系,而是檢察機(jī)關(guān)內(nèi)設(shè)的多個(gè)部門,多個(gè)程序設(shè)置與“不同角色”律師之間的多元化、多向性關(guān)系總和。在檢察辦案環(huán)節(jié)中對(duì)律師權(quán)利的限制,其實(shí)質(zhì)是對(duì)信息的限制,是掌握優(yōu)勢(shì)信息的一方,以非正當(dāng)?shù)睦碛勺璧K自身優(yōu)勢(shì)信息按法定程序流向律師端信息洼地。沖突的起因在于檢察環(huán)節(jié)執(zhí)法司法的不規(guī)范,根結(jié)在于國(guó)家本位主義過(guò)度泛化,源頭是法治化進(jìn)程中法治不平衡的階段性表現(xiàn)。要在當(dāng)前“政策實(shí)施”功能占據(jù)主導(dǎo)地位的司法機(jī)關(guān)權(quán)力生態(tài)中消解檢律關(guān)系沖突,就需要通過(guò)程序環(huán)節(jié)減少產(chǎn)生信息沖突的可能場(chǎng)域、消除滋生信息沖突的法律空間、增加獲取信息的替代途徑,并賦予沖突裁斷決定的強(qiáng)制效力。
[Abstract]:The prosecutorial relationship is not only the single antagonistic relationship between the case contractor and the defense lawyer, but the sum of the pluralistic and multidirectional sexual relations between the procuratorial organs and the lawyers with "different roles". In the link of procuratorial handling of cases, the limitation of lawyers' rights is essentially the restriction of information and the party who holds the dominant information, which hinders the flow of dominant information to the information depression of lawyers according to the legal procedure for improper reasons. The cause of the conflict lies in the non-standard law enforcement in the procuratorial link, the root of which lies in the excessive generalization of the national standard, and the source is the phased manifestation of the imbalance of the rule of law in the process of rule of law. In order to resolve the conflict of procuratorial relationship in the power ecology of judicial organs, which has the dominant function of "policy implementation", it is necessary to reduce the possible field of information conflict through the procedure link, eliminate the legal space that breeds information conflict, increase the alternative way of obtaining information, and endue the mandatory effect of conflict decision.
