【摘要】：委托調(diào)解制度是一種非訟化糾紛解決機(jī)制,對于緩解法院訴訟壓力,降低當(dāng)事人糾紛解決成本具有重要意義。但是由于立法的缺失,委托調(diào)解經(jīng)驗(yàn)的不足,實(shí)踐中存在諸多制約委托調(diào)解發(fā)展的因素,所以有必要對委托調(diào)解制度進(jìn)行研究,以為該制度完善提供理論支持。 本文主要從以下幾個(gè)方面對委托調(diào)解制度進(jìn)行了探討： 第一部分主要分析委托調(diào)解的基本理論,對委托調(diào)解的概念,特征進(jìn)行了介紹,再將委托調(diào)解與訴訟調(diào)解,人民調(diào)解進(jìn)行比較,以期更好地對委托調(diào)解進(jìn)行定性,同時(shí)也介紹了委托調(diào)解的功能,從而能夠明確發(fā)展委托調(diào)解的現(xiàn)實(shí)意義。 第二部分主要是對法國的法院調(diào)解制度、日本的法院調(diào)停制度、美國附設(shè)在法院的調(diào)解、加拿大的法院調(diào)解制度和我國臺灣地區(qū)的法院附設(shè)調(diào)解分別進(jìn)行了考察,以期對我國委托調(diào)解制度的完善有所啟示。 第三部分主要是對我國委托調(diào)解的立法現(xiàn)狀和實(shí)踐模式進(jìn)行了考察,同時(shí)也對當(dāng)前委托調(diào)解存在的問題進(jìn)行了歸納和分析,以期了解當(dāng)前我國委托調(diào)解制度的整體現(xiàn)狀,從而可以有針對性地進(jìn)行改進(jìn)和完善。 第四部分主要是針對我國委托調(diào)解立法和實(shí)踐中存在的問題,分別從提高立法層面、規(guī)范委托調(diào)解的主體、界定委托調(diào)解案件的范圍和完善委托調(diào)解的程序等方面提出了完善我國委托調(diào)解制度的意見,以期對我國委托調(diào)解制度的發(fā)展有所裨益。
[Abstract]:The entrustment mediation system is a kind of non-litigation dispute resolution mechanism, which is of great significance to alleviate the pressure of court litigation and reduce the cost of dispute resolution between the parties. However, due to the lack of legislation and the lack of experience of entrusted mediation, there are many factors restricting the development of entrusted mediation in practice, so it is necessary to study the entrusted mediation system in order to provide theoretical support for the perfection of the system. This paper mainly discusses the entrustment mediation system from the following aspects: the first part mainly analyzes the basic theory of entrustment mediation, introduces the concept and characteristics of entrusted mediation, and then compares the entrusted mediation with litigation mediation and people mediation, in order to better characterize the entrustment mediation, and also introduces the function of entrustment mediation, so as to be able to clearly develop the practical significance of entrusted mediation. The second part mainly investigates the court mediation system in France, the court mediation system in Japan, the court mediation system attached to the court in the United States, the court mediation system in Canada and the court attached mediation in Taiwan, respectively, in order to enlighten the perfection of the entrustment mediation system in our country. The third part mainly investigates the legislative status and practical mode of entrustment mediation in our country, and also sums up and analyzes the problems existing in entrustment mediation at present, in order to understand the overall situation of entrustment mediation system in our country, so as to improve and perfect it pertinently. The fourth part mainly aims at the problems existing in the legislation and practice of entrustment mediation in our country, and puts forward some suggestions on perfecting the entrusted mediation system in our country from the aspects of improving legislation, standardizing the main body of entrusted mediation, defining the scope of entrusted mediation cases and perfecting the procedure of entrustment mediation, so as to be beneficial to the development of entrustment mediation system in our country.
