主審法官辦案責(zé)任制研究

【摘要】:縱觀整個(gè)人類社會(huì)各個(gè)歷史時(shí)期,人們對(duì)司法公正的要求越來(lái)越高,并且一直在追尋司法能夠公平、公正,而法官對(duì)司法公正具有重要的影響。法官是“法律由精神王國(guó)進(jìn)入現(xiàn)實(shí)王國(guó)控制社會(huì)生活關(guān)系的大門(mén),法律借助法官而降臨塵世”。然而,隨著我國(guó)經(jīng)濟(jì)的快速發(fā)展,帶來(lái)了各種社會(huì)問(wèn)題。急劇變化的社會(huì)也使得我國(guó)社會(huì)糾紛明顯地增多。法院在承擔(dān)社會(huì)矛盾、解決社會(huì)矛盾的角色上發(fā)揮了積極重要的作用。但是,面對(duì)日益增多的案件數(shù)量,法官的壓力越來(lái)越大。,改革法院審判權(quán)運(yùn)行機(jī)制,提高法官辦案的質(zhì)量與效率事不宜遲。我國(guó)正處于司法體制改革的關(guān)鍵時(shí)期,司法體制改革的核心在于提高司法公信力,提高司法公信力的關(guān)鍵在于能否讓法官獨(dú)立公正行使審判權(quán),從而真正實(shí)現(xiàn)“讓審理者裁判、由裁判者負(fù)責(zé)”。在我國(guó)司法實(shí)踐中,法官在辦案過(guò)程中的獨(dú)立審判權(quán)缺乏制度上的充分保障。法官在辦案過(guò)程中造成的冤假錯(cuò)案也時(shí)有發(fā)生。為了提高我國(guó)主審法官的辦案質(zhì)量以及防止冤假錯(cuò)案的發(fā)生,黨的十八屆三中全會(huì)明確提出改革主審法官辦案責(zé)任制度。2014年最高人民法院發(fā)布的《人民法院第四個(gè)五年改革綱要(2014-2018)》也將“完善主審法官、合議庭辦案責(zé)任制”作為關(guān)鍵環(huán)節(jié),并提出了相關(guān)的配套改革措施。由此可見(jiàn),主審法官辦案責(zé)任制已經(jīng)成為我國(guó)當(dāng)前司法改革中的重要環(huán)節(jié)。我國(guó)在主審法官責(zé)任制改革的過(guò)程中,無(wú)論在理論還是在實(shí)踐上均取得了較好的成果。但是,在主審法官的責(zé)任制改革中仍然存在著一些問(wèn)題。因此,對(duì)主審法官辦案責(zé)任制開(kāi)展研究仍具有較強(qiáng)的現(xiàn)實(shí)意義。本論文主要分為三個(gè)部分:第一部分對(duì)我國(guó)主審法官責(zé)任制的一般理論進(jìn)行了分析。首先,從概念界定入手,對(duì)主審法官、主審法官責(zé)任制進(jìn)行初步探討。其次,對(duì)主審法官責(zé)任制產(chǎn)生的理論基礎(chǔ)進(jìn)行分析,主要從權(quán)責(zé)一致、司法公正、司法效率三個(gè)方面對(duì)主審法官辦案責(zé)任制的產(chǎn)生作出深入的分析。再次,著眼于法學(xué)理論的角度,從消除司法行政化弊端、完善司法權(quán)力運(yùn)行機(jī)制、提升司法公信力、實(shí)現(xiàn)審判統(tǒng)一四個(gè)方面闡述主審法官辦案責(zé)任制的價(jià)值基礎(chǔ),為后文的論述打下堅(jiān)實(shí)的理論基礎(chǔ)。第二部分闡述了主審法官責(zé)任制實(shí)施中的現(xiàn)實(shí)困擾。從主審法官辦案責(zé)任制具體實(shí)施入手,總結(jié)實(shí)施過(guò)程中存在的問(wèn)題,從相關(guān)配套制度不夠完善、主審法官的主體地位有待加強(qiáng)、主審法官權(quán)力范圍不確定、主審法官追責(zé)標(biāo)準(zhǔn)不夠明確四個(gè)方面對(duì)主審法官辦案責(zé)任制加以剖析。第三部分提出了完善主審法官責(zé)任制的路徑。根據(jù)第二部分提出的主審法官辦案責(zé)任制在實(shí)施中存在的問(wèn)題,從完善相關(guān)配套制度、突出主審法官辦案的主體地位、厘清主審法官的權(quán)力范圍、明確主審法官責(zé)任認(rèn)定標(biāo)準(zhǔn)四個(gè)方面對(duì)完善主審法官責(zé)任制提出改進(jìn)意見(jiàn),以便主審法官辦案責(zé)任制更好地在實(shí)施過(guò)程中運(yùn)行。

The thesis is divided into three parts: the first part analyses the general theory of the responsibility system of the presiding judge in China. Secondly, the author analyzes the theoretical basis of the responsibility system of the presiding judge, and makes an in-depth analysis of the responsibility system of the presiding judge on the basis of the three aspects of the accrual, the judicial justice and the judicial efficiency. Thirdly, based on the angle of the law theory, the paper expounds the value basis of the responsibility system of the presiding judge in four aspects, such as the elimination of the malpractices of the administration of justice, the improvement of the operation mechanism of the judicial power, the promotion of the credibility of the judicial system and the realization of the unification of the trial, and lays a solid theoretical foundation for the following discussion. The second part expounds the real problem in the implementation of the responsibility system of the presiding judge. Starting with the implementation of the responsibility system for handling the case of the presiding judge, the problems existing in the implementation process are summarized, the main status of the presiding judge is to be strengthened, and the power scope of the presiding judge is not determined. The judge's accountability standard of the presiding judge is not clear, and the case-handling responsibility system of the presiding judge is analyzed. The third part puts forward the way to improve the responsibility system of the presiding judge. according to the problems existing in the implementation of the case-handling responsibility system of the presiding judge put forward by the second part, It is clear that four aspects of the criteria for determining the responsibility of the presiding judge are to improve the responsibility of the presiding judge, so that the responsibility system of the presiding judge can be better operated in the course of implementation.
