【摘要】：在我國,人民陪審員制度作為一項(xiàng)重要訴訟制度,一直是理論界和司法實(shí)務(wù)界關(guān)心的重大課題之一,2005年5月《關(guān)于完善人民陪審員制度的決定》的正式實(shí)施,更以立法形式奠定了人民陪審員制度在國家司法制度中的地位。然而陪審員“陪而不審、審而不議”現(xiàn)象的廣泛存在,使該制度沒能得到良好的運(yùn)行。本文將觀察視角從制度本身轉(zhuǎn)移到導(dǎo)致制度運(yùn)行不暢的現(xiàn)象入手,從實(shí)證的角度審視我國出現(xiàn)“陪而不審”現(xiàn)象的原因,并以求實(shí)的心態(tài)從中探討如何減少該現(xiàn)象的發(fā)生,從而推動(dòng)我國人民陪審員制度進(jìn)一步完善,以求為人民陪審員制度的實(shí)踐研究增量。 本文共分三大部分。第一部分分類呈現(xiàn)我國人民陪審員制度的運(yùn)行現(xiàn)狀。主要介紹目前我國人民陪審員制度在官方、新聞媒體以及筆者所在地區(qū)法院人民陪審員制度三方面呈現(xiàn)的運(yùn)行現(xiàn)狀。并從中窺探出目前“陪而不審”現(xiàn)象在我國人民陪審員制度運(yùn)行過程中確實(shí)是普遍存在的。第二部分系統(tǒng)闡述“陪而不審”現(xiàn)象。通過介紹“陪而不審”現(xiàn)象的產(chǎn)生和表現(xiàn)形式,分析產(chǎn)生“陪而不審”現(xiàn)象的原因,并列舉和分析目前社會(huì)各界解決“陪而不審”現(xiàn)象采取的各類對(duì)策。第三部分從完善人民陪審員制度入手破解“陪而不審”現(xiàn)象。從制度、實(shí)踐以及管理三方面系統(tǒng)提出完善人民陪審員制度的方法,進(jìn)而有效破解“陪而不審”現(xiàn)象。 本文以“陪而不審”現(xiàn)象為研究對(duì)象,通過對(duì)“陪而不審”現(xiàn)象的表現(xiàn)形式、產(chǎn)生的原因和破解途徑等內(nèi)容進(jìn)行研究,最終達(dá)到完善人民陪審員制度這一目的。采用調(diào)查法和統(tǒng)計(jì)分析法對(duì)德陽兩級(jí)法院目前陪審現(xiàn)狀做調(diào)查研究,從中獲取基礎(chǔ)數(shù)據(jù),在數(shù)據(jù)分析的基礎(chǔ)上歸納推理出目前人民陪審員制度運(yùn)行中存在的普遍問題；采用文獻(xiàn)研究的方法對(duì)前人研究成果進(jìn)行歸納總結(jié),以此作為本文研究的邏輯起點(diǎn)；采用邏輯思維的方法在對(duì)文獻(xiàn)資料和調(diào)查資料整理的基礎(chǔ)上進(jìn)行思維加工,探索出破解“陪而不審”現(xiàn)象的方法,希望能在前人努力的基礎(chǔ)上,利用自己的知識(shí)積累和調(diào)查研究最終在完善人民陪審員制度問題上做出有益探索。
[Abstract]:In China, the people's jury system, as an important litigation system, has always been one of the major issues of concern to the theoretical and judicial practice circles. The formal implementation of the decision on perfecting the people's jury system in May 2005, It also establishes the position of the people's jury system in the national judicial system in the form of legislation. However, the widespread existence of the phenomenon of "accompany without trial, trial without discussing" makes the system not run well. This article transfers the observation angle from the system itself to the phenomenon that causes the system to run not smooth, examines the reason of "accompany without trial" phenomenon in our country from the positive point of view, and probes into how to reduce the occurrence of this phenomenon with the realistic mentality. So as to promote the further perfection of the people's jury system in our country, in order to be the increment of the practice research of the people's jury system. This paper is divided into three parts. The first part of the classification presents the operational status of the people's jury system in China. This paper mainly introduces the present situation of our country's people's jury system in three aspects: the official, the news media and the people's jury system of the district court in which the author works. At present, it is found that the phenomenon of "accompany without trial" is universal in the running process of the people's jury system in our country. The second part expounds the phenomenon of "accompany without trial" systematically. By introducing the appearance and manifestation of the phenomenon of "accompany without trial", this paper analyzes the causes of the phenomenon of "accompany without trial", and lists and analyzes the countermeasures adopted by all walks of life at present to solve the phenomenon of "accompany without trial". The third part begins with perfecting the system of people's jurors to solve the phenomenon of "accompany without trial". From the three aspects of system, practice and management, this paper puts forward the methods of perfecting the system of people's jurors, and then effectively solves the phenomenon of "accompany without trial". This paper takes the phenomenon of "accompany without trial" as the object of study, through the study of the manifestation of the phenomenon of "accompany without trial", the causes and ways of solving, etc., to achieve the purpose of perfecting the system of people's jurors. The present situation of jury in Deyang courts is investigated by means of investigation method and statistical analysis method, from which the basic data are obtained, and the common problems existing in the operation of the people's jury system are summed up and deduced on the basis of data analysis. Using the method of literature research to summarize the previous research results as the logical starting point of this paper; The logical thinking method is used to process the thinking on the basis of sorting out the literature and investigation materials, and to explore the way to solve the phenomenon of "accompany without trial", hoping to build on the basis of previous efforts. Making use of their own knowledge accumulation and investigation to make a useful exploration on perfecting the system of people's assessors.
