LY監(jiān)獄企業(yè)管理問題診斷

【摘要】：監(jiān)獄在實現(xiàn)對罪犯的改造過程中,組織罪犯參加生產(chǎn)勞動,就會涉及到勞動資料和勞動場所等問題,同時罪犯勞動又會產(chǎn)生一定的勞動價值,創(chuàng)造經(jīng)濟(jì)效益,因此監(jiān)獄企業(yè)產(chǎn)生了。監(jiān)獄企業(yè)是為監(jiān)獄改造罪犯提供勞動場所并實現(xiàn)對罪犯職業(yè)化教育的特殊經(jīng)濟(jì)組織,是因監(jiān)獄的存在而存在的。目前,在“監(jiān)企合一”的體制下,我國監(jiān)獄企業(yè)經(jīng)濟(jì)運(yùn)行情況總體不好。雖然各監(jiān)獄基本都成立了監(jiān)獄企業(yè)公司,并按照公司治理方式設(shè)置了監(jiān)獄企業(yè)組織結(jié)構(gòu),但實施“監(jiān)企分開”的監(jiān)獄和監(jiān)獄企業(yè)仍然在一個監(jiān)獄組織領(lǐng)導(dǎo)之下。 目前我國關(guān)于監(jiān)獄企業(yè)公司治理、產(chǎn)權(quán)結(jié)構(gòu)的相關(guān)文獻(xiàn)甚少,而僅有的幾篇論述也僅僅停留在政策層面上,監(jiān)獄企業(yè)的改革和發(fā)展問題尚在探索中。本文以公司治理理論和管理學(xué)理論為依據(jù),針對LY監(jiān)獄企業(yè)管理問題提出診斷報告,以探索我國監(jiān)獄企業(yè)公司治理新模式。全文共分六部分,第一章主要介紹介紹LY監(jiān)獄企業(yè)背景、規(guī)模、組織結(jié)構(gòu)及本課題研究目的意義。第二章闡述關(guān)于監(jiān)獄企業(yè)公司治理過程中應(yīng)用的相關(guān)理論,因為監(jiān)獄企業(yè)的特殊性,沒有哪一種理論可以直接適用監(jiān)獄企業(yè)的治理結(jié)構(gòu),并在此部分解釋了監(jiān)企分開的概念。第三章敘述LY監(jiān)獄企業(yè)歷史演化過程,現(xiàn)在的經(jīng)營、管理現(xiàn)狀。第四章為本文的主要部分,從LY監(jiān)獄企業(yè)內(nèi)因、外因以及和監(jiān)獄的存在關(guān)系三個方面診斷出LY監(jiān)獄企業(yè)存在的問題,并對這些問題進(jìn)行分析,指出LY監(jiān)獄企業(yè)目前存在的最根本性問題。第五章根據(jù)上一章診斷出的問題為LY監(jiān)獄企業(yè)管理提出對策與建議,設(shè)計出LY監(jiān)獄企業(yè)管理的新模式。第六章為結(jié)論和展望。
[Abstract]:In the process of realizing the reform of criminals, organizing criminals to participate in productive labor will involve problems such as labour materials and workplaces. At the same time, criminal labor will produce a certain labor value and create economic benefits. So the prison business came into being. The prison enterprise is a special economic organization which provides the work place for the prison to transform the criminal and realizes the professional education for the criminal, and it exists because of the existence of the prison. At present, under the system of "the integration of supervision and enterprise", the economic performance of prison enterprises in China is generally not good. Although prisons have basically established prison enterprise companies and have set up prison enterprise organizational structures in line with corporate governance, prisons and prison enterprises that implement "prison-enterprise separation" are still under the leadership of a prison organization. At present, there are few literatures about the corporate governance and property right structure of prison enterprises in our country, but the only few articles only stay on the policy level. The reform and development of prison enterprises are still in the process of exploration. Based on the theory of corporate governance and management, this paper puts forward a diagnostic report on the management of LY prison enterprises in order to explore the new mode of corporate governance of prison enterprises in China. This paper is divided into six parts. The first chapter mainly introduces the background, scale, organization structure of LY prison and the significance of the research. The second chapter expounds the relevant theories on the process of prison enterprise corporate governance, because of the particularity of prison enterprises, no theory can be directly applied to the governance structure of prison enterprises, and in this part explains the concept of separation between prison and enterprise. The third chapter describes the LY prison enterprise history evolution process, the present operation, the management present situation. The fourth chapter is the main part of this paper, from the three aspects of the internal and external causes of LY prison enterprises and the relationship between the existence of the prison and diagnosed the problems of LY prison enterprises, and analyze these problems. This paper points out the most fundamental problems existing in LY prison enterprises. According to the problems diagnosed in the last chapter, the fifth chapter puts forward some countermeasures and suggestions for the management of LY prison enterprise, and designs a new mode of LY prison enterprise management. The sixth chapter is the conclusion and prospect.
