行政追償啟動(dòng)機(jī)制的建構(gòu)

【摘要】:我國(guó)行政賠償制度的迅猛發(fā)展,要求行政追償制度的發(fā)展速度與之匹配,但由于立法的缺陷和粗疏,導(dǎo)致行政追償制度的價(jià)值遠(yuǎn)未實(shí)現(xiàn)。由于行政追償主體立法設(shè)計(jì)的內(nèi)部性,行政追償權(quán)難以啟動(dòng),而激活行政追償制度的第一步恰恰又是行政追償權(quán)的依法行使。應(yīng)延伸法院的審判職能,在行政賠償訴訟中植入司法建議書制度;落實(shí)檢察院的行政檢察監(jiān)督職能,將行政機(jī)關(guān)怠于行使行政追償權(quán)納入行政公益訴訟的受案范圍。
[Abstract]:The rapid development of the administrative compensation system in our country requires the development speed of the administrative recovery system to match it, but due to the defects and carelessness of the legislation, the value of the administrative recovery system is far from being realized. Due to the internality of the legislative design of the subject of administrative recourse, the right of administrative recourse is difficult to start, and the first step of activating the system of administrative recourse is precisely the exercise of the right of administrative recourse according to law. The judicial function of the court should be extended, the judicial recommendation system should be implanted in the administrative compensation lawsuit, the procuratorate's function of administrative procuratorial supervision should be carried out, and the administrative organ should be put into the scope of the administrative public interest litigation.
