和諧社會下現(xiàn)代監(jiān)獄管理新理念的探索

【摘要】：監(jiān)獄作為國家的刑罰執(zhí)行機關(guān),社會上層建筑的重要組成部分,歷來都是維護階級統(tǒng)治、保障社會公正、實現(xiàn)社會治理的工具,其獨特的職能作用,直接關(guān)系著執(zhí)政地位的鞏固、社會秩序的穩(wěn)定和政治文明的發(fā)展。特別是在貫徹“依法治國”的基本方略,落實“以人為本”的科學(xué)發(fā)展觀,構(gòu)建社會主義和諧社會的條件下,黨和國家明確提出“切實維護黨的執(zhí)政地位、國家安全、人民權(quán)益,確保社會大局穩(wěn)定,是政法戰(zhàn)線的首要政治任務(wù)”。就目前我國監(jiān)獄管理而言,不僅監(jiān)獄干警思想觀念陳舊,治監(jiān)理念落后,運行機制僵化,而且根深蒂固的習(xí)慣性思維、經(jīng)驗化管理、程式化教育和傳統(tǒng)化行為的模式,致使對于罪犯的管理、矯正和教育改造及其權(quán)益的保障,常常會受到“觀念因素”的干擾和“思維方式”的制約,不能適應(yīng)社會文明與時代發(fā)展對監(jiān)獄工作的新要求。因此,探索研究監(jiān)獄管理理念的創(chuàng)新發(fā)展,業(yè)已成為推進監(jiān)獄管理由安全模式向質(zhì)量模式的根本性轉(zhuǎn)變,實現(xiàn)監(jiān)獄工作由人治走向法治,由傳統(tǒng)走向科學(xué)的重要課題。本文擬以“和諧社會下現(xiàn)代監(jiān)獄管理新理念的探索”為研究視角,提出了關(guān)于樹立和落實“以人為本,依法治監(jiān),科學(xué)改造”之監(jiān)獄管理理念的核心架構(gòu)。文章主要分為四部分,具體內(nèi)容如下： 第一部分：現(xiàn)代監(jiān)獄管理理念創(chuàng)新的必要性與核心架構(gòu)。這部分通過對監(jiān)獄屬性及其職能的定位；通過對監(jiān)獄管理理念現(xiàn)狀的認識和對社會發(fā)展客觀要求的解讀；通過對監(jiān)獄管理理念創(chuàng)新諸因素的考量。闡明監(jiān)獄管理與構(gòu)建和諧社會的關(guān)系,監(jiān)獄管理理念創(chuàng)新的必要性,確立“以人為本,依法治監(jiān),科學(xué)改造”之現(xiàn)代監(jiān)獄管理理念的核心架構(gòu)。 第二部分：樹立和落實以人為本的管理理念。這部分主要闡明：以人為本管理理念的基本內(nèi)涵；以人為本管理理念的目標取向；以人為本管理理念的價值功能；以人為本管理理念的實踐要求。 第三部分：樹立和落實依法治監(jiān)的管理理念。這部分主要是對依法治監(jiān)管理理念的基本內(nèi)涵與價值屬性的闡釋,通過對依法治監(jiān)管理理念的目標要求與規(guī)制缺失等問題的分析,闡明推進監(jiān)獄法治建設(shè)的基本途徑與具體實踐。 第四部分：樹立和落實科學(xué)改造的管理理念。這部分從六個層面闡述了堅持科學(xué)改造理念需要把握的重點環(huán)節(jié)。即：在強化教育改造上要有新機制；在健全完善安全管理上要有新突破；在提升科學(xué)矯正水平上要有新目標；在構(gòu)建罪犯改造質(zhì)量上要有新體系；在推進社會綜合治理上要有新舉措；在豐富監(jiān)區(qū)文化建設(shè)上要有新方略。
[Abstract]:As an important part of the state penalty enforcement organ and the social superstructure, prison has always been a tool to safeguard class rule, safeguard social justice and realize social governance. It is directly related to the consolidation of ruling position, the stability of social order and the development of political civilization. In particular, under the conditions of carrying out the basic strategy of "governing the country according to law", carrying out the scientific development concept of "people-oriented" and constructing a harmonious socialist society, the Party and the state clearly put forward the following points: "earnestly safeguarding the ruling position of the Party and national security," The rights and interests of the people and the stability of the overall situation of society are the primary political tasks on the political and legal front. " As far as prison management in our country is concerned, not only the prison police have outdated ideas, but also the concept of prison administration is backward, the operating mechanism is rigid, and there are deep-rooted habitual thinking, experiential management, stylized education and the mode of traditional behavior. As a result, the management, correction and educational reform of criminals and the protection of their rights and interests are often disturbed by "concept factors" and restricted by "mode of thinking", and can not meet the new requirements of the development of social civilization and times for prison work. Therefore, exploring and studying the innovation and development of prison management concept has become an important subject to promote prison management from safety mode to quality mode, to realize prison work from rule by man to rule by law and from tradition to science. From the perspective of "the exploration of the new concept of modern prison management in a harmonious society", this paper puts forward the core framework of establishing and implementing the concept of "people-oriented, managing prison according to law and reforming scientifically". The article is divided into four parts, the specific contents are as follows: the first part: the necessity and core structure of the innovation of modern prison management concept. This part through to the prison attribute and the function localization; through to the prison management idea present situation understanding and the understanding to the social development objective request; through to the prison management idea innovation various factors consideration. This paper expounds the relationship between prison management and the construction of harmonious society, the necessity of the innovation of prison management idea, and establishes the core structure of modern prison management idea of "people-oriented, managing prison according to law, scientifically reforming". The second part: set up and carry out the management idea of people-oriented. This part mainly expounds the basic connotation of the people-oriented management concept; the goal orientation of the people-oriented management concept; the value function of the people-oriented management concept; the practical requirements of the people-oriented management concept. The third part: set up and carry out the management idea of managing the prison according to law. This part is mainly about the explanation of the basic connotation and value attribute of the concept of managing the prison according to law, and through the analysis of the target requirement and the lack of regulation of the idea of managing the prison according to the law. Expound the basic way and concrete practice of advancing the construction of prison rule by law. The fourth part: set up and carry out the management idea of scientific transformation. This part expounds the key links of adhering to the idea of scientific transformation from six levels. That is, there should be a new mechanism in strengthening education reform, a new breakthrough in improving safety management, a new goal in improving the level of scientific correction, a new system in constructing the quality of criminal reform; New measures should be taken to promote comprehensive social management and new strategies should be adopted to enrich the cultural construction of prison areas.
