【摘要】：初查是檢察機(jī)關(guān)辦理職務(wù)犯罪案件中非常重要的一項(xiàng)工作。初查工作的順利進(jìn)行也為刑事訴訟活動(dòng)的啟動(dòng)奠定了良好的基礎(chǔ),尤其是關(guān)系到能否立案以及初查中所搜集的證據(jù)材料是否具有可采性的問(wèn)題。1996年以來(lái),隨著《刑事訴訟法》的修改、《律師法》的出臺(tái)和《關(guān)于辦理死刑案件審查判斷證據(jù)若干問(wèn)題的規(guī)定》和《關(guān)于辦理刑事案件排除非法證據(jù)若干問(wèn)題的規(guī)定》的相繼發(fā)布,檢察機(jī)關(guān)屢屢將“偵查重心前移至初查環(huán)節(jié)”作為應(yīng)對(duì)的重要措施之一。但遺憾的是,初查至今未有明確的法律地位,這與初查的重要性是不相匹配的。檢察理論界與實(shí)務(wù)界對(duì)此重大問(wèn)題的探討仍處于初級(jí)階段,本文擬通過(guò)對(duì)初查歷史脈絡(luò)的梳理和對(duì)初查概念、特點(diǎn)、性質(zhì)的分析,指出初查的成因及其重要作用,分析初查面臨的困境并進(jìn)而提出完善的對(duì)策。
[Abstract]:The initial investigation is a very important task in the procuratorial organ handling the duty crime case. The smooth conduct of the initial investigation also laid a good foundation for the initiation of criminal proceedings, especially in relation to the possibility of filing a case and the admissibility of the evidentiary materials collected during the preliminary investigation. With the revision of the Criminal procedure Law, the promulgation of the lawyers Law and the promulgation of the provisions on the examination and judgment of evidence in handling death penalty cases, and the provisions on the exclusion of some illegal evidence from handling criminal cases, The procuratorial organ often regards the center of investigation forward to the initial investigation as one of the important measures to deal with it. Unfortunately, the initial investigation has no clear legal status, which does not match the importance of the initial investigation. The discussion of this important problem in the procuratorial theory and practice is still in the primary stage. This paper points out the cause of the initial investigation and its important role by combing the historical context of the initial investigation and analyzing the concept, characteristics and nature of the initial investigation. Analyze the predicament that the initial investigation faces and then put forward the perfect countermeasure.
