【摘要】：近年,律師在維護社會穩(wěn)定、服務(wù)經(jīng)濟建設(shè)、參與法律援助、參加公益活動等方面做出了突出的成績,為社會和諧做出了貢獻(xiàn)。但由于種種原因社會公眾對律師職業(yè)形象產(chǎn)生了一些負(fù)面的看法。因此,重振律師行業(yè)的正氣,樹立良好的律師職業(yè)形象,已成為律師行業(yè)發(fā)展的當(dāng)務(wù)之急。 本文共分五個部分。第一部分是緒論,筆者通過一些具體案例的闡述,引發(fā)出對律師職業(yè)形象進行研究的必要性,此外對國內(nèi)外的研究動態(tài)的論述為本文的研究奠定前提。第二部分對律師職業(yè)形象相關(guān)的基本概念進行了界定,并深入分析了良好的律師職業(yè)形象對整個律師業(yè)的發(fā)展、社會主義法治國家的建設(shè)以及社會公平正義的實現(xiàn)都有著重要意義。第三部分介紹了當(dāng)前我國律師業(yè)職業(yè)形象存在的問題,諸如:不負(fù)責(zé)任,喪失原則;弄虛作假,誠信缺失;行賄受賄,惡性競爭;業(yè)務(wù)不精,素質(zhì)不高;私自收費,漫天要價;修養(yǎng)不夠,道德滑坡等。第四、五部分作為本課題主體,針對律師職業(yè)形象存在的上述問題,從法律環(huán)境、文化歷史、經(jīng)濟社會、監(jiān)督管理以及律師自身等方面進行了原因分析,并提出了具體的解決途徑。
[Abstract]:In recent years, lawyers have made outstanding achievements in maintaining social stability, serving economic construction, participating in legal aid, participating in public welfare activities and contributing to social harmony. However, for a variety of reasons, the public has produced some negative views on the professional image of lawyers. Therefore, to revive the integrity of the lawyer profession and establish a good image of the lawyer profession has become an urgent task for the development of the lawyer profession. This paper is divided into five parts. The first part is the introduction, the author through some specific cases of elaboration, triggered the need to study the professional image of lawyers, in addition to the domestic and foreign research trends for the study of the premise. The second part defines the basic concepts related to the lawyer's professional image, and deeply analyzes the development of the whole lawyer industry by the good lawyer's professional image. The construction of a socialist country ruled by law and the realization of social justice are of great significance. The third part introduces the problems existing in the professional image of lawyers in China, such as: irresponsibility, loss of principles, fraud, lack of good faith, bribery, vicious competition, poor business, poor quality, private fees, excessive asking price; Lack of self-cultivation, moral decline, etc. The fourth and fifth parts, as the subject of this subject, analyze the reasons from the aspects of legal environment, culture and history, economy and society, supervision and management as well as lawyers themselves, aiming at the above problems existing in lawyers' professional image. And put forward the concrete solution way.
