【摘要】：社區(qū)矯正自2003年在上海、北京等試點開展到現(xiàn)在已經(jīng)歷了十年的時間，2012年3月1日正式實施的《社區(qū)矯正實施辦法》雖然為社區(qū)矯正工作帶來了法律依據(jù)和標(biāo)準(zhǔn)，但在實踐中依然存在著大量的問題急需解決，筆者試圖從理論角度來分析目前我國社區(qū)矯正制度存在的問題，如：社區(qū)矯正以“問題”為視角，缺乏科學(xué)的心理治療方法以及注重“監(jiān)督管理”，忽視“矯正管理”等問題來分析，提出了積極心理學(xué)與社區(qū)矯正在積極性、向善性和預(yù)防性方面具有契合性，將積極心理學(xué)的理念引入到社區(qū)矯正中的構(gòu)想與建議。 在將積極心理學(xué)應(yīng)用到社區(qū)矯正中的措施中，提出了建立軍事訓(xùn)練學(xué)校，在軍事訓(xùn)練學(xué)校中通過規(guī)定被矯正人員參加運動訓(xùn)練、戶外生存項目、文體活動、傳統(tǒng)文化教育等活動來提升和培養(yǎng)被矯正人員的積極情緒、積極人格以及建立積極的社交關(guān)系，并從積極心理學(xué)角度分析了規(guī)定被矯正人員參加公益勞動的意義和可行性，提出了在社區(qū)矯正過程中，被矯正人員通過參加換位思考訓(xùn)練，培養(yǎng)體諒他人、感恩社會等積極品質(zhì)，建立積極的人生觀、價值觀，最終達(dá)到預(yù)防犯罪的目的。 在論文的最后，提出了將心理治療中的積極心理治療模式引入到社區(qū)矯正中，，取代傳統(tǒng)的心理治療，發(fā)揮積極心理治療在激發(fā)被矯正人員人性的閃光點，培養(yǎng)被矯正人員的積極性的品質(zhì)和積極的人際關(guān)系等方面的優(yōu)勢，達(dá)到幫助被矯正人員順利解矯，實現(xiàn)自我，重新找到生活意義的目的。
[Abstract]:Community correction has been carried out in Shanghai, Beijing and other pilot projects for ten years since 2003. Although the implementation measures of Community Corrections, which were formally implemented on March 1, 2012, have brought legal basis and standards to community correction work, However, there are still a lot of problems that need to be solved in practice. The author tries to analyze the problems existing in the current community correction system from a theoretical point of view, such as: community correction from the perspective of "problem". The lack of scientific psychotherapy methods, the attention to "supervision and management" and the neglect of "corrective management" are analyzed, and it is pointed out that positive psychology and community correction are compatible in the aspects of positivity, kindness and prevention. This paper introduces the idea of positive psychology into the conception and suggestion of community correction. In the course of applying positive psychology to community correction, this paper puts forward the establishment of military training schools, in which correctees are required to participate in sports training, outdoor survival projects, and sports activities. Traditional cultural education and other activities to promote and cultivate the positive emotions, positive personality and the establishment of positive social relations, and from the perspective of positive psychology to analyze the significance and feasibility of regulating the corrected personnel to participate in public service labor. It is put forward that in the process of community correction, the corrected personnel can take part in training for the sake of others, cultivate the positive qualities such as considerate others, appreciate the society, establish positive outlook on life and values, and finally achieve the purpose of crime prevention. At the end of the paper, the positive psychotherapy model in psychotherapy is introduced into community correction to replace the traditional psychotherapy, and to bring active psychotherapy into play in stimulating the human nature of the corrected personnel. In order to cultivate the positive quality and positive interpersonal relationship of the corrected personnel, we can help the corrected personnel to solve the correction smoothly, realize themselves and find the meaning of life again.
