【摘要】：確定行政檢察的對象和方式應以檢察機關的憲法定位為出發(fā)點和歸宿。根據(jù)我國憲法和法律規(guī)定,行政檢察的對象具體應包括:人民法院的行政審判的活動和行政機關的行政行為,對于后者包括具體行政行為和抽象行政行為。根據(jù)法律和司法解釋規(guī)定,行政檢察的方式主要包括檢察機關進行事實調(diào)查、提出行政抗訴或者再審檢察建議、提出檢察建議或者檢察意見、提起行政公訴。
[Abstract]:To determine the object and mode of administrative procuratorial organ should take the constitutional orientation of procuratorial organ as its starting point and destination. According to the constitution and law of our country, the object of administrative procuratorial should include the activities of administrative trial of people's court and the administrative behavior of administrative organ, and the latter includes concrete administrative act and abstract administrative act. According to the law and judicial interpretation, the way of administrative prosecution mainly includes the procuratorial organ to carry on the fact investigation, to put forward the administrative protest or the retrial procuratorial suggestion, to put forward the procuratorial suggestion or the procuratorial opinion, and to initiate the administrative public prosecution.
