【摘要】："檢察"與"監(jiān)督"兩個詞語在表述上能夠互換對等使用的狀況,顯現(xiàn)了在當(dāng)今中國的理論界與實務(wù)界,對現(xiàn)代檢察制度的權(quán)力屬性和基本權(quán)能的一種認(rèn)知與理解。依照不同語境的考證,在中文方面,"檢察"與"監(jiān)督"兩詞所指的語義確實相近。在外文方面,prōcūrōtor、prōsequor所產(chǎn)生的相關(guān)詞語,其語義主要為"代理"和"控訴",在其沿革過程中,從未含有"監(jiān)督"的內(nèi)容�；趯χ型�"檢察"相關(guān)詞語表述方式的分析與比較,表明域外有關(guān)"檢察"的相應(yīng)用語中包含著歷史性、制度性的內(nèi)容、依據(jù)與背景,并且其有著從"公訴"職能的維度來把握和理解檢察制度的習(xí)慣、傳統(tǒng)與趨勢。為此,應(yīng)在開放性的前提下,對國內(nèi)有關(guān)域外"檢察"詞語和現(xiàn)代檢察制度的相應(yīng)知識內(nèi)容與認(rèn)知方式,進(jìn)行必要的反思。
[Abstract]:The condition that "procuratorial" and "supervision" can be used interchangeably and equally in expression shows a kind of cognition and understanding of the power attribute and basic power of modern procuratorial system in the theoretical and practical circles of China today. According to the textual research of different contexts, the semantics of "procuratorial" and "supervision" are similar in Chinese. In the aspect of foreign language, the related words produced by sequor are mainly "agent" and "complaint". In the process of its evolution, there has never been the content of "supervision". Based on the analysis and comparison of the expressions of Chinese and foreign "procuratorial" words, it is shown that the corresponding expressions of "procuratorial" in foreign countries contain historical, institutional content, basis and background. And it has the habit, tradition and trend to grasp and understand the procuratorial system from the function of public prosecution. Therefore, under the premise of openness, the necessary reflection should be made on the corresponding knowledge content and cognitive mode of foreign "procuratorial" words and modern procuratorial system in China.
