論文化與司法職業(yè)的融合與提升

【摘要】：本文站在哲學層面觸碰文化與司法職業(yè)的關(guān)系,通過研究文化與司法職業(yè)的融合與提升,探討整個司法職業(yè)的核心價值觀：“忠誠、公正、民本”。忠誠即忠于祖國、忠于法律；公正即依法履行職責,維護公平正義；民本即以人民為本,堅持執(zhí)法為民。忠誠是基石,公正是靈魂,民本是主旨,三者構(gòu)成一個辯證統(tǒng)一的整體。本文以此價值觀為核心試建構(gòu)司法職業(yè)文化體系,以期明晰對司法職業(yè)文化的不同認識。同時揉合物質(zhì)文化、制度文化與精神文化在司法職業(yè)中的作用,找到文化與司法職業(yè)的契合點,加強文化管理,真正做到文化建設指導司法實踐,司法實踐又促進文化建設的作用。 筆者認為司法系統(tǒng)應圍繞“忠誠、公正、民本”的職業(yè)核心價值觀開展文化構(gòu)建,用物質(zhì)手段豐富司法職業(yè)物質(zhì)文化,用制度手段推動司法職業(yè)文化,用精神手段提升司法職業(yè)文化。文化決定司法職業(yè)的過去、現(xiàn)在和將來,司法職業(yè)應該保護文化的健康良性發(fā)展。我們應該建立國家文化安全預警系統(tǒng),強化涉外文化安全管理,實施積極對外文化政策,建立健全文化管理法律法規(guī),防止境外資本對媒介的滲透,提高民眾文化認同感,依法保護知識產(chǎn)權(quán),加強對進入我國的境外文化產(chǎn)品的管理,堅決打擊盜版及文化產(chǎn)品非法流入行為。同時我們應該運用法律武器和國際規(guī)則對文化進行保護,司法職業(yè)對文化的保護也體現(xiàn)了國家的主權(quán)和尊嚴。文化通過價值觀、人生觀、善惡觀、世界觀的不斷滲透到個人的思維中,進而改變行為,改變選擇,改變每一次的執(zhí)法與司法行為,不斷塑造著司法職業(yè)者,進而確定每個人在司法職業(yè)中的定位。司法職業(yè)者應當把文化修養(yǎng)當成一種自覺行動,從專業(yè)文化上深研,從多元文化中吸收,不斷提升自身的文化水平以促進職業(yè)生涯的成功與完善。 本文的研究方法為文獻研究方法,兼有實證研究方法。具體采用觀察法、資料分析法等。由于論文所涉及到的內(nèi)容網(wǎng)絡及法學書籍中能引用的很少,前人雖有涉及,但未就文化與司法職業(yè)之間的關(guān)系作系統(tǒng)論述,所以對于概念性的內(nèi)容只作引用,未作過多的闡釋與探討,文中大量采用所查閱的內(nèi)部文件和資料以及自己的所思所想,謬漏難免,肯請諸位賜教。
[Abstract]:Standing on the philosophical level, this paper touches the relationship between culture and judicial profession. By studying the fusion and promotion of culture and judicial profession, this paper discusses the core values of the whole judicial profession: "loyalty, justice, people-oriented". Loyalty is loyalty to the motherland and the law; justice is to perform duties according to law and to safeguard fairness and justice; the people is based on the people and insists on enforcing the law for the people. Loyalty is the foundation stone, justice is the soul, the people is the main idea, and the three constitute a dialectical unity. This paper tries to construct the system of judicial professional culture with values as the core, in order to clarify the different understanding of judicial professional culture. At the same time, it combines the function of material culture, system culture and spiritual culture in the judicial profession, finds the joint point of culture and judicial profession, strengthens the culture management, and really achieves the cultural construction to guide the judicial practice. Judicial practice also promotes the role of cultural construction. The author thinks that the judicial system should construct the culture around the core values of loyalty, justice and people, enrich the material culture of the judicial profession by material means, and promote the judicial professional culture by the means of system. To promote the judicial professional culture by spiritual means. Culture determines the past, present and future of judicial profession. We should establish a national early warning system for cultural security, strengthen the management of foreign cultural security, implement active foreign cultural policies, establish and improve laws and regulations on cultural management, prevent the infiltration of foreign capital into the media, and enhance the people's cultural identity. We will protect intellectual property rights in accordance with the law, strengthen the management of foreign cultural products entering our country, and resolutely crack down on piracy and illegal inflow of cultural products. At the same time, we should use legal weapons and international rules to protect culture. The protection of culture by judicial profession also embodies the sovereignty and dignity of the country. Through values, outlook on life, view of good and evil, the world view of the continuous infiltration into the individual thinking, and then change behavior, change choice, change every law enforcement and judicial behavior, constantly shaping the judicial profession, Then determine the position of each person in the judicial profession. The judicial profession should regard cultural accomplishment as a kind of conscious action, deeply study from the professional culture, absorb from the multiculturalism, improve one's own culture level continuously in order to promote the success and consummation of the professional career. The research method of this paper is literature research method and empirical research method. Specific methods of observation, data analysis and so on. Because the content network and the law books involved in the paper can be quoted few, although the predecessors have involved, but did not discuss the relationship between culture and judicial profession, so the conceptual content is only cited.
