【摘要】：近年來,地方法院制定司法解釋性文件的現象較為普遍。這其中,高級法院的司法解釋性文件是通過滿足上級法院與下級法院的需求,從而發(fā)揮著一種"承上啟下"的功能。對上,高級法院制定司法解釋性文件的活動,一定程度上緩解了最高法院司法解釋的供給壓力;對下,高級法院的司法解釋性文件又不同程度地滿足了下級法院法律適用的需求,繼而使得下級法院與高級法院在法律適用方面的一體化程度增強。2015年修訂后的《立法法》仍延續(xù)著既往司法解釋制度一味強調"堵"住地方法院司法解釋資源供給的思路,但現實生活中由于正式的司法解釋資源不能滿足法律適用的需求,仍舊大量出現地方法院的司法解釋性文件,導致了對現行司法解釋制度目標——法律適用統(tǒng)一性的"內卷化"效應。解決這一矛盾的出路,需要反思現行司法解釋制度,實現對高級法院司法解釋的權力配置由"堵"到"疏"的方向轉變。
[Abstract]:In recent years, the phenomenon of local courts making judicial explanatory documents is more common. Among them, the judicial explanatory document of the High Court is to meet the needs of the higher court and the lower court, so as to play a "connecting link" function. To a certain extent, the activities of the High Court to formulate judicial explanatory documents have alleviated the pressure on the Supreme Court to provide judicial interpretation. The judicial explanatory documents of the High Court meet, to varying degrees, the needs of the lower courts for the application of the law. Then the lower courts and the higher courts become more integrated in the application of the law. The Legislative Law, as amended in 2015, still continues the idea that the past judicial interpretation system has always emphasized "blocking" the supply of judicial interpretation resources in the local courts. However, due to the fact that the formal judicial interpretation resources can not meet the needs of the application of the law, there are still a large number of judicial explanatory documents of the local courts. It leads to the effect of the unification of the application of law to the target of the current judicial interpretation system. In order to solve this contradiction, we should reflect on the current judicial interpretation system and realize the transformation of the power allocation of the judicial interpretation of the higher court from "blocking" to "sparse".
