【摘要】：近年來民事強(qiáng)制執(zhí)行予以單獨(dú)立法的呼聲日趨高漲，民事強(qiáng)制執(zhí)行單獨(dú)立法必然涉及民事執(zhí)行權(quán)的合理配置這一核心問題。當(dāng)前我國(guó)法學(xué)界對(duì)民事執(zhí)行權(quán)配置問題一直爭(zhēng)論不休，，沒有形成共識(shí)。首先，對(duì)民事執(zhí)行權(quán)的性質(zhì)存在爭(zhēng)論；其次民事執(zhí)行權(quán)到底應(yīng)當(dāng)配置在哪個(gè)或者哪幾個(gè)國(guó)家機(jī)關(guān)；第三，民事執(zhí)行機(jī)關(guān)如何設(shè)置職能機(jī)構(gòu)，才能使民事執(zhí)行權(quán)的權(quán)能得以充分發(fā)揮。 本文主要從司法實(shí)務(wù)實(shí)踐的視角研究我國(guó)民事執(zhí)行權(quán)的合理配置和科學(xué)運(yùn)行的問題，并與國(guó)外民事執(zhí)行權(quán)配置作比較對(duì)象，分析我國(guó)現(xiàn)行法律規(guī)范對(duì)民事執(zhí)行權(quán)運(yùn)行的保護(hù)不足之處和司法缺陷的成因分析，得出當(dāng)前民事執(zhí)行權(quán)的優(yōu)化配置應(yīng)從宏觀、微觀兩方面分別考量，并對(duì)存在的問題提出完善對(duì)策。同時(shí)對(duì)基層人民法院人民法庭的民事執(zhí)行實(shí)施權(quán)的配置與運(yùn)行提出構(gòu)想和建議。
[Abstract]:In recent years, there are more and more calls for civil enforcement to legislate separately. The core problem of civil enforcement power is the rational allocation of civil enforcement power. At present, the allocation of civil execution power has been debated in the legal circles of our country, and no consensus has been formed. First, there is a dispute over the nature of the civil enforcement power; secondly, which or several state organs should be allocated the civil enforcement power; third, how to set up the functional organs of the civil enforcement organs, Only then can the power of civil execution be brought into full play. This paper mainly studies the rational allocation and scientific operation of civil executive power in China from the perspective of judicial practice, and makes a comparison with foreign civil execution power allocation. This paper analyzes the deficiencies of the protection of the civil enforcement power and the causes of the judicial defects in the current legal norms of our country, and draws the conclusion that the optimal allocation of the civil enforcement power should be considered separately from the macro and micro aspects. And put forward the perfect countermeasure to the existing problem. At the same time, it puts forward some ideas and suggestions on the disposition and operation of the civil execution power of the people's courts at the grass-roots level.
