【摘要】：改革開放以來,隨著我國(guó)經(jīng)濟(jì)和社會(huì)的快速發(fā)展,出現(xiàn)了些諸如環(huán)境污染、國(guó)有資產(chǎn)流失等涉及到損害社會(huì)公共利益和國(guó)家利益的現(xiàn)象。公益訴訟案件也越來越多。律師通常是公益訴訟的積極的發(fā)動(dòng)者和參與者。 但是,我國(guó)未對(duì)公益訴訟做相關(guān)的立法規(guī)定,律師參與公益訴訟缺乏資金及其它方面的支持,導(dǎo)致律師參與公益訴訟現(xiàn)狀并不樂觀。本文力圖從明確公益訴訟的概念和淵源開始,分析我國(guó)律師參與公益訴訟的現(xiàn)狀和問題,提出構(gòu)建我國(guó)公益訴訟和公益律師制度的建議。文章主要從以下部分展開： 第一章主要從公益訴訟的概念和淵源入手,分析了國(guó)外的公益訴訟現(xiàn)狀和公益律師,對(duì)我國(guó)的公益訴訟和律師參與公益訴訟現(xiàn)狀進(jìn)行了分析,提出了關(guān)鍵問題。 第二章對(duì)我國(guó)的律師參與公益訴訟的必要性和可行性進(jìn)行分析。 第三章通過對(duì)現(xiàn)階段我國(guó)律師參與公益訴訟的現(xiàn)實(shí)困境分析,筆者認(rèn)為我國(guó)律師參與公益訴訟缺乏制度的保障,原告資格問題和訴訟成本問題是阻礙律師參與公益訴訟的“攔路虎”。 第四章筆者對(duì)構(gòu)建我國(guó)的公益訴訟和公益律師制度提出了自己的建議,認(rèn)為需要加強(qiáng)公民和律師公益訴訟意識(shí)的培養(yǎng)、構(gòu)建培養(yǎng)公益律師的專門制度,從立法賦予律師提起公益訴訟的原告資格問題,最后建立公益訴訟程度制度和激勵(lì)制度。
[Abstract]:Since the reform and opening up, with the rapid development of our economy and society, there have been some phenomena such as environmental pollution, loss of state-owned assets and so on, which are related to the damage to social public interests and national interests. Public interest litigation cases are also increasing. Lawyers are usually active initiators and participants in public interest litigation. However, our country does not make the relevant legislation stipulation to the public interest lawsuit, the lawyer participates in the public interest lawsuit lacks the fund and the other aspect support, causes the lawyer to participate in the public interest lawsuit present situation is not optimistic. This paper tries to clarify the concept and origin of public interest litigation, analyzes the current situation and problems of lawyers' participation in public interest litigation, and puts forward some suggestions on the construction of public interest litigation and public interest lawyer system in China. The first chapter starts with the concept and origin of public interest litigation, and analyzes the current situation of public interest litigation and public interest lawyers in foreign countries. This paper analyzes the current situation of public interest litigation and lawyers' participation in public interest litigation in China, and puts forward some key issues. The second chapter analyzes the necessity and feasibility of lawyers' participation in public interest litigation. The third chapter analyzes the current situation of lawyers' participation in public interest litigation in our country. The author thinks that our lawyers' participation in public interest litigation lacks the guarantee of system. The problem of plaintiff's qualification and litigation cost is an obstacle to lawyers' participation in public interest litigation. In the fourth chapter, the author puts forward his own suggestions on the construction of public interest litigation and public interest lawyer system in our country, and thinks that it is necessary to strengthen the cultivation of citizen and lawyer's awareness of public interest litigation, and to construct a special system to train public interest lawyer. Finally, the system of the degree of public interest litigation and the incentive system are established.
