【摘要】：目前我國(guó)所建立的案件質(zhì)量評(píng)估制度,旨在以量化的方式對(duì)整體司法活動(dòng)進(jìn)行考核、匯總與引導(dǎo),其涵蓋當(dāng)前技術(shù)水平、認(rèn)知水平進(jìn)步所帶來(lái)的福利,目的是促使審判管理實(shí)現(xiàn)科學(xué)化、精細(xì)化和系統(tǒng)化的轉(zhuǎn)型。但在現(xiàn)有條件下,案件質(zhì)量評(píng)估制度卻無(wú)法實(shí)現(xiàn)設(shè)計(jì)者的主觀(guān)意圖,制度設(shè)計(jì)的失誤與指標(biāo)治理的困境阻礙了制度預(yù)期的“指揮棒”功能的發(fā)揮。實(shí)際上,案件質(zhì)量評(píng)估制度根本就沒(méi)有能力滿(mǎn)足社會(huì)的此種功能需求,功能互惠結(jié)構(gòu)中的案件質(zhì)量評(píng)估制度受到結(jié)構(gòu)的宰制而失去了功能自主,反而產(chǎn)生出強(qiáng)化司法行政化的隱性功能。
[Abstract]:At present, the case quality evaluation system established in our country aims to assess, aggregate and guide the overall judicial activities in a quantitative way. It covers the benefits brought about by the current technological level and the progress of cognitive level. The purpose is to promote the scientific, refined and systematic transformation of trial management. However, under the existing conditions, the case quality evaluation system can not realize the subjective intention of the designer, and the system design errors and the predicaments of index governance hinder the expected "baton" function of the system. In fact, the case quality assessment system simply does not have the ability to meet the functional needs of society, and the case quality assessment system in the functional reciprocal structure is ruled by the structure and loses its functional autonomy. On the contrary, it produces a recessive function of strengthening the administration of justice.
