【摘要】：我國(guó)檢察機(jī)關(guān)是國(guó)家法律監(jiān)督機(jī)關(guān),是中國(guó)政權(quán)建設(shè)和法制建設(shè)進(jìn)程中的歷史選擇,承擔(dān)著維護(hù)社會(huì)和諧穩(wěn)定和公平正義的重要職責(zé)。檢察機(jī)關(guān)的各項(xiàng)職能都與建設(shè)社會(huì)主義和諧社會(huì)密切相關(guān),在貫徹依法治國(guó)基本方略、維護(hù)社會(huì)和諧穩(wěn)定、積極化解社會(huì)矛盾、促進(jìn)社會(huì)公平正義方面具有不可替代的作用。黨的十七大提出“全面落實(shí)依法治國(guó)基本方略,加快建設(shè)社會(huì)主義法治國(guó)家”和“深化司法體制改革”,給檢察工作指明了前進(jìn)的方向,明晰了奮斗目標(biāo)。檢察工作一體化機(jī)制就是響應(yīng)黨的號(hào)召,落實(shí)“深化司法體制改革”,對(duì)檢察機(jī)制進(jìn)行的一種創(chuàng)新,本文試就此問(wèn)題進(jìn)行探討。 本文由四部分構(gòu)成,第一部分著重介紹檢察工作一體化的相關(guān)理論,辨析“檢察工作一體化”、“檢察一體化”、“部門(mén)一體化”,同時(shí)分析了實(shí)施檢察工作一體化的的該當(dāng)性,以及分析檢察工作一體化的一個(gè)重要因素一一檢察權(quán)的屬性,提出檢察權(quán)屬于偏向司法權(quán)的復(fù)合性檢察權(quán),這對(duì)檢察工作一體化的邊界有重要意義。第二部分對(duì)重點(diǎn)分析了我國(guó)檢察工作一體化機(jī)制在運(yùn)行過(guò)程中所暴露出的問(wèn)題,同時(shí)分析了國(guó)外的檢察一體化制度,并分析了國(guó)外檢察一體化制度的特點(diǎn),對(duì)我國(guó)檢察工作一體化有借鑒作用。第三部分構(gòu)建我國(guó)檢察工作一體化機(jī)制,分析我國(guó)檢察工作一體化的未來(lái),提出要通過(guò)外部機(jī)制變革去保障檢察工作一體化機(jī)制的實(shí)現(xiàn),主要是通過(guò)改變領(lǐng)導(dǎo)模式,創(chuàng)新財(cái)政制度,建立人事保障體系和利用科技等幾個(gè)方面去構(gòu)建外部環(huán)境,同時(shí)還要檢察機(jī)關(guān)內(nèi)部不斷完善,從而保障檢察工作一體化機(jī)制的實(shí)現(xiàn),主要是通過(guò)建立書(shū)面存檔制度,責(zé)任明晰制度,以及對(duì)檢察機(jī)關(guān)的機(jī)構(gòu)重新設(shè)置去不斷完善檢察工作一體化機(jī)制。第四部分為結(jié)束語(yǔ)。 本文主要采用文獻(xiàn)研究法、經(jīng)驗(yàn)總結(jié)法、描述性研究法、考察比較法和探索性研究法,從檢察工作一體化的內(nèi)涵入手分析,對(duì)比國(guó)外檢察一體化制度,分析其特點(diǎn),綜合分析我國(guó)檢察工作一體化的現(xiàn)狀,找出存在的缺陷與不足,最后提出相關(guān)的解決措施。
[Abstract]:The procuratorial organ of our country is the national legal supervision organ, is the historical choice in the process of China's political power construction and legal system construction, and undertakes the important duty of maintaining social harmony and stability and fairness and justice. The functions of procuratorial organs are closely related to the construction of a harmonious socialist society. They play an irreplaceable role in carrying out the basic strategy of governing the country according to law, maintaining social harmony and stability, actively resolving social contradictions, and promoting social fairness and justice. The Seventeenth National Congress of the Communist Party of China put forward "implementing the basic strategy of governing the country according to law in an all-round way, speeding up the construction of a socialist country ruled by law" and "deepening the reform of the judicial system", which pointed out the direction of the procuratorial work and clarified the goal of struggle. The integrated mechanism of procuratorial work is an innovation of the procuratorial mechanism in response to the call of the Party and the implementation of "deepening the reform of the judicial system". This paper tries to discuss this issue. This paper is composed of four parts. The first part mainly introduces the relevant theories of procuratorial work integration, differentiates and analyzes the "procuratorial work integration", "procuratorial integration", "departmental integration", At the same time, this paper analyzes the appropriateness of the implementation of the integration of procuratorial work and the attribute of procuratorial power, which is an important factor in the integration of procuratorial work, and puts forward that the procuratorial power belongs to the compound procuratorial power, which is biased towards judicial power. This is of great significance to the boundary of the integration of procuratorial work. The second part focuses on the analysis of the problems exposed in the operation of the procuratorial work integration mechanism in China, and also analyzes the foreign procuratorial integration system, and analyzes the characteristics of the foreign procuratorial integration system. It can be used as a reference for the integration of procuratorial work in our country. The third part constructs our country's procuratorial work integration mechanism, analyzes the future of our country's procuratorial work integration, proposes to guarantee the realization of the procuratorial work integration mechanism through the external mechanism transformation, mainly by changing the leadership mode. We should innovate the financial system, establish a personnel security system and use science and technology to build an external environment. At the same time, we also need to constantly improve the procuratorial organs, so as to ensure the realization of an integrated mechanism for procuratorial work. Mainly through the establishment of the system of filing in writing, the clear system of responsibility, and the re-establishment of the procuratorial organs to constantly improve the procuratorial work integration mechanism. The fourth part is the conclusion. This article mainly uses the literature research method, the experience summary method, the descriptive research method, inspects the comparison method and the exploratory research method, from the procuratorial work integration connotation analysis, contrasts the foreign procuratorial integration system, analyzes its characteristic. This paper comprehensively analyzes the present situation of the integration of procuratorial work in our country, finds out the defects and shortcomings, and finally puts forward some relevant measures.
